I thought if the word wasnt used in the same business then it was ok?
that is.. a company named synapse that made toilet seats couldnt sue a company named synapse that made medical equipment on the grounds that their name was the same. |

in any event.. WHO in their right mind thinks of monster cable when they see a clothing shop called Monster Vintage? or vice versa?
its STUPID. How can anyone with an IQ above 10 really and truely deepdown think otherwise? I think if anyone should be sued.. it should be Monster Cable for harrassing all of these people |

Absolutely shocking and disgusting. It looks like they are on the one hand trawling for settlement cash and on the other trying to set a tone of intimidation within which to extort said cash.
If one were Attila, even if people surrendered in the face of overwhelming odds, you'd still need to do a massacre every once and a while to protect your "brand identity". Sic semper tyrannus. |

If I remember right Trademark law in the UK says you can have the same business name as somebody else in the same area as long as you aren't trading in the same product. I'm not sure about the rest of the world or how it applies to global sales though. So by their reckoning no other company in the world can trade with the word Monster!? Hmmm... |

I don't see how they could hope to ever win a suit. I imagine they just launch these suits because the other companies know it's cheaper just to sign some sort of agreement than go to court.
"Monster" is in the dictionary as an adjective; hence, although I'm not a legal expert, I believe it cannot be a trademarked name. That would be like Red Lobster suing The Red Ribbon (made up name) over their use of "Red", which is clearly just a common adjective describing colour. "Monster" is just another way of saying "Freakin' big!" Stupid.... Greg |

yeah you're probably right on that, lunch money, hehe.. but it just seems like legal form of extortion to me.. just a quick way to make a buck off of someone else.. theivery.. bleh. I wonder who over at monster cable got this bright idea and sold the company on using it? |

I agree that it's just extortion. What a bunch of fucknuts. One of their family must be a lawyer who said, "You know... most cases get settled out of court because people couldn't be arsed...." |

My personal favorite that Monster Cable has sued: BOUDREAUX'S CAJUN KITCHEN, INC. - HOME OF THE MONSTER SHRIMP! Yeah, people are really going to get those two confused. "What? You mean to tell me that this delicious spicy fried shrimp I've been eating wasn't made by the same people that make my audio cables? f**k! I feel so cheated!" |

Yeah, that one got me, too.
I bet all the restaurants who market a "monster-sized breakfast" are getting worried. Or do they only have to worry if they call it a "Monster Breakfast"? |
