Undoubtedly, there is financial gain. It should be necessary to buy a license, request a NFR, use a fork from the 2Dat or earlier discoDSP sources, or compile it yourself.chk071 wrote: Sun Dec 18, 2022 11:28 am Imagine someone uses (the free version of) Obxd in a monetarized Youtube video which is supposed to explain the basics of subtractive synthesis. I guess it's prohibited to do that?

In that circumstance, turning around those options would be equivalent to piracy. Do not promote that. Of course you can delete the video and use another product without such restrictions if that's what you meant.

I'd understand such rough tactics for the musicians community if literally everything about what makes OBXD the OBXD was done by discoDSP exclusively. But it's NOT. What about people in this community, and perhaps, not just this alone, who have largely contributed to the current state of OBXD and helped it grow?
These people never ever said: "If you use OBXD in your song, you must pay me a percentage, because, who knows, you could use my preset or use my GUI skin or whatever".
People who have supplied all these amazing skins, designed amazing presets, contributed other parts to what makes OBXD the OBXD it is today, don't they have a say in all this?
I've seen discoDSP grabbing all these beautiful skins and presets and stuffing them into OBXD very quickly, and I don't particularly remember discoDSP asking permit before doing that. Why? You're very strict about your work, why you're not as strict when it comes to work of others?
No asking for permit, everything is added automatically. Once something useful is posted, BAM! like crack of two fingers it is added to the program, adding to the overall value of OBXD at the same time. Voila! But why don't you ask permit first?
So, when it's time to take advantage of other people's work, it's OK, lets grab it, but if YOU want to gain something from OBXD yourself, no no no, ah ah ah, don't touch it, you must shell out first.
Yeah, you could tell that, formally, you provide VST2 for free, but when you restrict financial use, you practically render OBXD useless altogether.
I'd like to see all these people who've contributed to OBXD development demonstrate the same strictness and uncompromising attitude as discoDSP and demand a similar restriction, meaning, to strip OBXD of everything they've contributed over the years, helping OBXD to grow as an instrument and become the synth it is today. Or keep the features, but ask money for their work.
It's fair, right? Why discoDSP is allowed to charge money for these people's work, OBXD is sold with their contributions included, right? It's not sold separately, it's sold with these features added.
While these contributors are not getting paid at all, and more so, these contributors are not even allowed to use OBXD in their songs and at least get profit for their work this way? What kind of a BS deal is that?
Then I'd watch how much of a commercial appeal will be left of OBXD for discoDSP to gain from, when most of it is taken back. OBXD surely won't be the same, that I can tell. If this guy is allowed to change the rules on the fly, so are these contributors. Fair is fair.
But you know what? These people probably won't do that, they won't go as far. Why? Because they're not shady a$$, mercantile philistines, who change the rules on the fly in attempt to rip off a quick buck.
Someone here could learn a lesson from them for sure!

The GPL allows no other restrictions on its terms and requires publication of the source code. The personal license agreement with the original author waives this, so all is well for now.

Which assets are these, exactly? Were they distributed with earlier versions, or as part of the work conveyed under GPL as a whole? Is it anything in the GitHub repository?discoDSP wrote: Sun Dec 18, 2022 11:21 am Indeed previous version binaries are still tied to GPL3 but be aware that the blobs, assets and resources have always been copyrighted to discoDSP and legally you're only allowed to distribute the plugin files without anything else in case you want to.
Given the language added to the GitHub repository ("This repository will remain available for historic purposes..."), it rather looks like your plan moving forward is for any further development to no longer be open source. That's fair, but if anyone else wants to take up development from the GPL version, it's important to know which assets in the repository you consider not to be covered by that license.

Artwork and any other non-source code blobs always retain their own copyright. You can compile the project perfectly without those.

Most of the presets from OB-Xd are from Kvr community, so it should be ok to use them on a fork, I guess

discoDSP OB-Xd is free to use with a single condition: no commercial use allowed unless registered.
2Dat builds are available for those who don’t want to pay with exactly the same sound and 90% of the presets.
The situation for end users hasn’t changed at all and the conflict with the original license has been settled personally with the author.
The issue now comes from people who are distributing the package and didn’t were aware that the copyright is retained for some elements. To me it’s a marginal problem.
Musicians will continue to enjoy and make use of OB-Xd exactly the same as they did in the last decade.

The non-commercial clause was a year ago if not more... and our current source code remains GPL3 so if you want to replace the artwork, make new builds and distribute them, feel with the right and free to do so. That’s the beauty of open source. Good luck.

The custom artwork is not yours! Almost all good, usable OBXD skins were provided by the KVR community FOR FREE. And you, never asking permit of the authors, very arrogantly and ignorantly included them into software and charge money for other people's work. These skins were not designed by you, so you can't claim it.replace the artwork
I swear, if I were the author of those custom GUIs, I would cancel everything today. No more free stuff for you to sell. No custom skins, no preset banks, I would require you to strip OBXD of everything and leave just the bare bones.
Then I'd gladly look how many OBXD licenses you'd sell having a bald emperor with no clothes. Ungrateful swine.
