I have checked my emails from DR.
They anounced the new Master Services Agreement in am email on sept 9th, 2024
It says that new Master Services Agreement becomes active on oct 16, 2024.
It includes new fees.
What hat email does not not:
- include any link to that new Master Services Agreement, so I was unable to read that new agreement before it came effective
- does not state the number (which is 6.3 as it showed up on oct 16)
I.
So, can this be used to claim that new Agreement is not effective?
II.
As it became effective oct 16, 2024, for the payments for july and august still the old agreement applies and they clearly violated that.

That's the fun part: The invoice doesn't give any indication about where they expect us to transfer the amount due whatsoever.

I see this just as a calculation of refunds and bad usage of wording (Invoice). They can put on invoice only their fees but, my opinion, only after they provide list of all transfer that they did (I would say that they are obliged to do that). At the end, I do not trust them until the proof is provided that refunds are really transffered. If necessary, this will go over lawyers.

Ah, ok.
But I got the email with the notificaion for july on aug 9, so they did not keep the 30 days, it was > 100 days.
But I think that does not matter anyway, as I see no way to make them pay for the delay, nor to force them to pay august, spetember, october.

I would need to have a copy of the latest MSA 6.3 to send to my lawyer.
Can someone please put the latest MSA 6.3 somewhere and provide me with a download link, or send it to me as an attachment? I no longer have access to my DR account and I can't get a copy.
Thanks
Stefano

I saved one as PDF, but it does not contain a version number. Funny. Of course I have no "contract library" anymore, so it doesn't help that I still have access to the CP.

I got that too, their fees (31 euros for support costs whoa) were deducted from the 14K they owe us over that period (also mentioned on that credit note). So they did offset it with the money they have to pay out (but likely never will).Christian67587 wrote: ↑Sun Nov 03, 2024 8:25 am 1st November I got an email with subject "MyCommerce Credit Note 31-OKT-2024 [CRN_P]".
And that had an invoice from DR about their fees.
My open case in their system about the due diligence doc I filled in twice and why we weren't paid got a reply today that some info was incorrect in the due diligence doc (it was correct, the AI bot apparently couldn't read the bank statement)... 5 months after I filled it in, now something/one looked at it.
I have no hope we'll get our money back

Did not get paid since July. A few days ago they sent a "due diligence" message: "Payments Blocked until Documentation and Review is Complete". They are requesting documents that I don't have such as a bank statement of a corporate account.
It's hard to take this seriously, why didn't they ask these documents 4 months ago ? If there is a class action suit or joint effort that I can participate in, please count me in.

We received the July sales payment on November 1st. On October 25th, we independently refunded all sales from July, August, and September, as we had little hope of being paid.
We then received a "credit memo" for all the refunded sales, plus an additional amount of around $15K USD with no details, just the total figure. About 20% of clients have already re-ordered, and we’re hopeful that 60–80% will do the same, so there’s a good chance we might recover most of our losses. We will gladly refund the July payment given DR cancel for good their silly "credit memo".
Today, as others have noted, we’re unable to log in. Perhaps DR noticed that many vendors issued refunds and decided to stop the outflow? I have no idea how DR plans to handle the multitude of legal cases, given the hundreds (if not thousands) of vendors across dozens of countries, the fact they’re operating at 25% staffing, and the likelihood that income has dried up with so many vendors leaving.
Who knows where this will end up. I can’t help but find it a bit ironic that this whole mess, stirred up by Barry Kazoff, who proudly showcases his many qualifications, has reached this point
