...in today's market and society. I am doing a research paper on WAREZ (i.e. cracked software) and was wondering what some of your thoughts were on P2P networks. Any opinions or input wiLL be very much appreciated...
1)...Can we control it in order to give manufacturers and software developers their due? How?
2)...Do you think the P2P user would purchase the software if it was not available as a crack? Or are they just browsers?
3)...In your experience (or knowledge), what sites have the most readily available files for music software? music cds? for art software? for games?
4)...with so many free resources (KVR) for free plugins, do you believe Music Software will become more affordable or that prices will continue to rise... ($2,700 for EastWest Quantum Leap Symphonic Orchestra Set and >$3,000 for WAVES DIAMOND BUNDLE come to mind)

Well, P2P isnt illegal as such, its what you share that is illegal. Anything that isnt for redistribution or has copyright or has been cracked, is illegal.
Even sharing free plugs is illegal unless you have permission.

I dont believe that the fact that there are so many free resources available will have nearly as much impact on the price of software as will the huge amount of people that are and will get into computer music. That includes all the big stars and the soon to be big stars.

P2P, in itself, isn't illegal. It's bootleggers that has made P2P evil by giving away illegal copies of anything (in a form of digital medium) without the written permission of the programmmers themselves. In most cases, no one is making any profits from this activity at all.
As for copyright laws, consider your own research as a three part story:
1. music/audios
2. movies/videos
3. softwares

The odds are 50/50. 50% of those who use crackwares would evenually buy the legal license copy of their favorite softwares (the increase popularity of Cubase & Pro-Tools during the early 1990's are perfect examples of this issues). 4. New commerial softwares will continue to rise in price ranges (Think: Tracktion 2 being at least $50 more than Tracktion 1.6) because the labor of making quality products will increase as computers' CPU-Power increases.

it's getting easier as computing power increases to have extremely tight copy protection - when i bought my Virus synth plug-in for my Powercore DSP card - TC Electronics actually generated a personalized copy of the software that will only run on my exact DSP card due to a code implanted in the hardware..

As long as there is code to be modified warez will always be a possibility. No matter how you obfuscate, hide code, make clever serializations. It's just a matter of how skilled and determined the cracker is and and if it's worth his trouble.

my main point about warez is always this:
- warez users will often claim that they are not 'hurting anyone' because they don;t have enough money to buy the product anyway, so no sales have been lost.
- but, while they may not have bought the expensive-to-buy cracked product, they would instead have been led to buy a cheaper product from a smaller developer; or even use some freeware from a keen newcomer.
- but instead, by using the warez, they do not buy the cheaper product, or support the new developer's freeware. they just act as pure parasites by taking something for free and giving absolutely nothing back

a) downloads it illegally, company makes no money, he gets the product
b) doesn't download it illegally, company makes no money, doesn't get the product.
the only difference here is whether the person gets the software.. so it's actually not affecting anything but him being able to enjoy it. . in both cases it's as if the person doesn't even exist to the company because there's a 0% chance of a purchase. i'm not trying to say that pirated software is a good thing though, cause a lot of people have the money and pirate software anyway, which is an unfair loss of sales.

Some thoughts about the subject.
Regarding Audio/Movies, it is all a mess I have to reckon, at the very time someone is a little "famous" you find his CD on all streets here on Venezuela, piracy here is very high, even my friends on the institute (the most important music university here) are amking CDs and selling them just to get enough money to pay rent.
Piracy on Audio/Movies has made a tremendous impact and I cannot see any solution on the near future. I guess one of them could be by promoting more live concerts than trying to sell so much records, records that have faked/fixed/arranged/tuned art on many cases.
On the other side, how many fine (but not "commercial" to the big industry) music has been brought to the masses becuase internet and piracy? thats an interesting point.
About software, I think this case is not that bad, mostly because many people, mostly REAL users no hobbists often prefers to buy their soft to get into the community and resources behind it, most of the time the mere software is useless (or it has very little potential) if you don't get tips from official forums, talking directly with the developers, downloading tutorials, files form their website etc...
I think those BIG BIG P2P communities are bad, for me that's the extreme side of piracy. Not to mention porn and gore involved.
Piracy has made companies to raise their prices more and more, but also it helped to speed up the "free software" movement. Piracy is a very interesting subject and you cannot see it from one single point of view.
Finally, there isn't a bigger pleasure than to be able to say, I OWN my software, they deserved the money I'm earning with their soft.
