No worries T-CM11.
I edited my post, just as you were replying, to make the whole situation clearer.
Ultimately, it is a moot point whether someone will spot a person 'altering' and reselling their original samples.
But it could prove costly to someone like Caine if he attempted it.

Now this is just quibbling over details, but aren't the "basic" waveforms in Omnisphere also short samples from other synths? Or does it actually generate mathematical waveforms internally?Caine123 wrote:ok thanks a lot guys, it is understandable of course.
i guess making a patch with oscs is not prohibited though ;D, cause this would be like patenting waveforms...
then i would use only omnisphere with the synthstuff for sampling.
Incomplete list of my gear: 1/8" audio input jack.

Maybe I just used the wrong topic to get something off my chest.
I hate how companies these days take away (personal) ownership (DRM!) and at the same time deny you any advantages of licensing. (yes it's off-topic - sorry!!
think: movies on optical media, games, etc... )

It's probably a gray area. They're so short that they're impossible to recognise - unless someone would sell them "raw".deastman wrote: Now this is just quibbling over details, but aren't the "basic" waveforms in Omnisphere also short samples from other synths? Exactly the same 'no' as it was in the previous 'can I sample Omnisphere' thread of yours I already linked to...Caine123 wrote:thanks a lot guys!
but i guess when i make e.g. with omnisphere some melodies -> render those -> then mangle i am ok with it am i?

ok thanks, this would be logic in my opinion!thecontrolcentre wrote:As I understand it ... you can legally sample and sell audio you create with any synth that is not sample based. You cannot sample and sell audio from a synth that is sample based without permission.
now i have to check whichvsts are non-sample based

Wavetable synths uses sinlge cycle (.wav) samples for it's waveforms.Caine123 wrote:ok thanks, this would be logic in my opinion!thecontrolcentre wrote:As I understand it ... you can legally sample and sell audio you create with any synth that is not sample based. The copyright laws in question are those which cover sound recordings. If you're not using an existing sound recording, there's no copyright issue.Caine123 wrote:yes thanks already acknowledged, 2nd subquestion was about synth sounds/made with the synthengine and people say it is prohibited as well. what i think is kinda dumb if true, cause how do people create their synth/preset/sound packages? excactly, with synths! then all soundpacks must be illegal cause i dont think zero-g build their own synth to produce a saw wave

Omnisphere has a full DSP synth included as well. As in, it's realtime synthesis with calculated OSCs instead of pulling data from the sample library. The language in the Spectrasonics sound license that forbids sound design use (as in, sound design for movies and games, i.e. creating sound effects using Omnisphere and using them as is, triggered in the end product with some corresponding action, in an effect context, instead of being an integral part of a musical work) is specifically targeted at creating stuff using the included sample material.deastman wrote:Now this is just quibbling over details, but aren't the "basic" waveforms in Omnisphere also short samples from other synths? I work in the games industry so I have previously contacted them about the licensing, and they have confirmed it is completely okay to do game/movie/etc. sound design with Omnisphere and the standard license as long as you stay 100% within the realtime DSP synthesis capabilities. If you want to use the included samples for things like that, you will need to contact them for extra licensing.
