For the guy to have gotten that, he must have had an history of crime or told the juge to go take a hike.

A good sentence of community service to help homeless people and if he doesn't do it right, send him a month in jail each time to reflect on being outside helping others or inside rotting away.

I actually couldn't find any details on the case that started this thread, but from what I saw on the link I posted, most of those getting 37+ months of jail time are being prosecuted for a lot more than $1,800 worth of illegal sales. It may have been 6 pieces of software worth $300 each, but they may have been sold thousands of times . . . without actual details on the case it's hard to make a judgement call.

In any case, theft is theft and rape is rape and screwing the poor to profit the rich is screwing the poor to profit the rich . . . they should all be punished according to the crimes (not that this is actually going to happen to the lawmakers who deserve it). I can't see that justifying one crime because of another gets us anywhere.

Two wrongs don't make a right and the end does not justify the means.

ALEX RODRIGUEZ was sentenced today to 37 months imprisonment for selling and distributing pirated computer software valued at over $1 million.

No, it's not petty theft. For starters, it's not any kind of theft whatsoever.

It's illegal, and it might be morally wrong, but it's not theft.

Claiming that it's worth over $1 million seems to be a bold claim in matters like these. It's not like his "customers" thought it was worth the retail price, so it's really difficult to speculate what kind of money the copyright holders lost due to Rodriguez actions.

The copies are valued at 1 millions dollars from the retailer/store but he didn't sell them at the retailer price. For instance he sold macromedia flash valued at $500 for $30.

Anyway they don't know exacly how much he sold. He could have made a million or more.

Whereas the Enron finance exec Dan Boyle got only 46 months jail time for fraudulently recording $12m in profits. The result of which was Enron going bankrupt, the loss of how many jobs and retirement plans? Not to mention the losses to stockholders and the huge energy prices so many Californians were forced to pay during Enron's price gouging days.

There have been several other convictions for Enron related conspirators, none worse than Boyle's so far. The big guys go on trial next year.

And Arthur Andersen got a fine of $500,000 and five years of probation for its involvement (obstruction of justice) and lost about 82,000 jobs.

So, all-in-all, it still sounds like the punishement isn't fitting the crime . . . but crime it still is.

perhaps it's better to do neither and get no time...corrupt politicians and bad judges doesn't mean we should ignore the law...it means we should do away with the incompetency and corruption instead...there is no better or lessor of two wrongs...though respect is still a concept lost on too many...and fwiw, can you back that up?

Good point. Someone should email that link to every shmoe who is trying to sell pirated software on ebay, craig's list and wherever else (ptp etc.). I don't but I wonder how many would stop immediately if they just saw something like this. WHO the hell would want to be in THIS guy's shoes? He has to pay 1.1 million dollars and go to jail for over 3 years? Big mistake.

squids unfortunately you will never convince some people of this...this is the new world, honesty is bad and dishonesty is good...that is of course unless you're the victim of dishonesty...then it's amazing how fast those people cross the road...and worse no doubt some judge will reverse that in appeals and all that will happen is the tax-payers will foot the bill for all the time wasted in court...but I'm with yah...I also believe that traffic laws here are a joke, speeding should cost you enough to hurt...too much leniency...a slap on the wrist and they wont do it again

The three years jail time seems a little harsh & as has been pointed out putting people in jail actually costs taxpayers a shit load of money - but that's really a discussion of much wider scope & significance.
I am glad to see one of those ebay scammers get punished though, as i'm never quite sure with ebay - some stuff is quite obviously warez & one immediately knows to steer clear (although I reckon a lot of kids buy it, sometimes knowingly sometimes not), but every now & then I see a 'bargain' & i'm completely unsure of whether I should go for it or not.
I don't have much faith in ebay anymore, but what can you/they do?
