I emailed them back once again, expressing my disappointment with their services. I have informed them that I will be moving elsewhere as well as my friend(who is in business with me).
I have also requested that they show me anywhere in the terms and conditions where it says anything about RAM or CPU usage. I asked for a pointer to anywhere that it says any kind of limits. I have read them and I know that the limits weren't expressed. I informed them that if they cannot point me to the terms that I "broke", I will expect a full refund.

By the way, I should clarify. The terms say that 10% CPU usage is the limit. I was quoted as going to 8.5%. It says NOTHING about RAM, and that is apparently what else I "broke". And I know that as being the reason servers were down yesterday, to increase RAM.

It's there, under support.
I have not checked the logs yet, but have informed them that I would like whatever reports they have as proof of any misuse. They use CPanel, so I believe I can get to the logs through that, although I've been pretty busy today so far.

I agree that something just doesn't seem right here. I was very stern in my responses to them. I have specifically asked them to show me any point in the TOS that shows any rule which I have broken. So far they cannot give me anything, but I once again am waiting for a response. They are very aware of what I'm wanting to happen. Unfortunately this means that ST won't be up for a while, and until I know it won't happen with a new host, I don't know if it will return any time soon.
This sucks, because A LOT of work has went into the site. We have been mentioned in such magazines as Sound On Sound and several websites around the net.

And for anyone who wonders, I signed up under a different site then their main one, and a different plan. It's a company they bought out last year and they still offer the plan, which is a better plan allowing more sites per plan. But they use the same servers, same support, same nameservers, etc. Just a different plan.
Can anyone see anything they can stand on? The only info I have so far is apparently an 8.5% CPU usage.

i suppose that could mean 10% of the CPU, or 10% of the memory, or 10% combined (8.5% CPU + 1.5% memory?) or 10% overall of the resources, 5% + 5%? i dunno, they've probably got enough of a legal team to cover them whatever, but just keeping pushing for a refund and hopefully you'll get it.As such, we reserve the right to make this decision at our sole discretion, based on a CPU and memory policy of 10%. This means, that if your website is found to be utilizing more than 10% of the CPU and memory of the service, we reserve the right to stop or correct the violation. Upon this, we will at the customers convenience provide alternative options, and a prorated refund.

Another vote for Bluehost (actually maybe not...if loads more people start using them then their service might suffer! plus I don't know if they're suitable for hosting a tracker).. If you've got a bunch of stuff to torrent perhaps check out legaltorrents.com and let them suck up the bandwidth hit.
