Digital River has a weird and obfucscated structure. I am wondering how our money is moved around between these companies:
- Digital River GmbH (Germany)
- Digital River Holding GmbH (Germany)
- Digital River Ltd (Ireland)
- Digital River (U.S.)

Cerberus, cerberus... Has no one noticed? Doesn't that ring a bell?The other party in this document is Cerberus Business Finance Agency, NY.
It seems that Digital River borrowed from Cerberus and other parties on multiple occasions since 2021, and now this is fifth agreement. I have no idea what this contract means, does it mean that DR will pay debt to Cerberus before all other obligations, even in the event of default ?
Cerberus is the multi-headed hell hound guarding the gates to the underworld, making sure that those who entered can never leave. So my theory is that DR was ordered to descend into the underworld, and loans from Cerberus are an instrument for that.

Similarly to what some others have reported, I too have now received payment for my July sales. This was due on 15th Aug and has been paid on 29th Oct.
Digital River have not replied to my case on this issue where I have requested payment in full for my Aug, Sep, and Oct sales and to close my a/c (since I have now ceased trading).

Some questions for all here who have received a payment for July now - can you please share details:
1) did you complete DR's KYC process and if yes when and how did they confirm your KYC status?
2) did you take legal action against DR?
3) did you do any refunds for your customers?
4) did you close your DR account?
Please share your answers here in the forum so that we all may be able to shed some light on DR's inconsistent behavior.

Yesterday we got an email that payment will follow (the normal email you know) -
and today indeed money came in

Due Dilligence filed in mid July and confirmed by them.
Bank account confirmation call was announced end of July but never actually received a call.
No message in the account that any action is required.
No refunds issued.
Account not closed, but were on the brink to move to the concurrency, however didn't plan to close the DR account still for a few month until it's clear what's up exactly in order not to get into the 180 days money lock.
No idea why now only the July period was paid since their new 60-days model in the new contract would require the AUGUST period to be paied (too) at the end of October

- Some months ago I completed a form DR sent me. It was extremely confusing and impossible to complete correctly. I submitted it saying I'd done the best I could. There has never been any response.
- I told them to consider a message I added to my "case" was a Letter before claim. This is done (in England and Wales) before taking someone to court to give them a chance to resolve things.
- I did not do any customer refunds not ask any customers to get refunds. My customers bought in good faith, their license keys are valid, and in any case because I've ceased trading they couldn't now buy from me if they wanted to.
- I told DR to close my a/c as soon as they had paid me in full. I also told them that I did not accept the new contract so they could not bill me for any monthly fees. I also contacted my bank to tell them to accept payments from DR but never to pay them a penny from my a/c.
I had the statement for my August sales at the start of September as usual (although that hasn't been paid), but I have had no statement for my September sales (which should have arrived at the beginning of this month).

Not according to new contract rules, sales report now come 30 days after the end of month.
So tomorrow, according to new terms, we should receive sales report for September, and payment for August.

Today, we received the payment for July, although all orders were canceled last Friday.
It’s unclear if the client will receive their refund, but DR has confirmed that refunds are processed for all orders.
This situation is quite a mess because there are more than 300 orders impacted! Let’s see how it unfolds—imagine if we end up owing DR money in the end!

Same situation here, I asked them if I should decline the payment so that funds are returned back to DR but have not receive any answer so far.
Almost four months of lost earnings since most of the orders are refunded and you can not charge customers for these past months.
