I'm seriously considering move my stuff to Bandcamp. Lets you sell your music and gives you all royalties. And as far as copyright goes, we've been using the same chromatic scale or element thereof during the last 10 centuries at least. Copyright laws has been around since like what? The 1800's? I'd say that in that case the scale wins flawlessly.

Yeah it's a sad strategy to making it harder for smaller artists to thrive, and larger artists easily horde (sp?) more royalties. The law gives the artist production the benefit of the doubt, even if the production is legit. US copyright law (under the DMCA) does not have a preemptive stipend written into it (from the DMCA: "Upon receipt of a compliant notification of claimed infringement, a service provider must respond expeditiously to remove, or disable access to, the material that is claimed to be infringing or to be the subject of the infringing activity, if the service provider seeks to receive the benefits of the limitations of liability contained in § 512(c). A service provider is not required by law to remove the allegedly infringing material, but upon receipt of a compliant notification will deemed to have been placed on notice of the allegedly infringing activity, and without the benefit of the limitations on liability contained in § 512, may face secondary liability for continuing to host the allegedly infringing material. "). The DMCA also states that there is no liability placed on the service providers (i.e. SoundCloud) to ensure that copyright material is protected, and it emphasizes several times that they are not financially liable for compensation to the copyright holders if copyright is infringed. So really, what benefit does SoundCloud gain from content ID, other than being able to implement a neat software technology? Unless there is some other M.O. involved (i.e. record company investors, looking out for their own).
So SoundCloud could be sued for damages if let's say you could prove that their lousy take down algorithm effected the sales of your rightfully owned production. They are walking a delicate fine line, and I'm surprised that no one has called them out on it. If someone holds a copyright, they have to go through proper legal channels to order a cease and desist. SoundCloud just cannot assume that every work that "sounds" like another is a copyright infringement. The burden of proof is on the copyright holder. Copyright laws are teh suck, and are outdated, for one, Secondly, it is not the place of a web-based middleware company to play copyright police. This is just plain bad business, and I suggest you all remove content from SoundCloud, and go to BandCamp, or any other platform that trusts its user base.

i also find soundcloud very annoying that when i play something, when the track ends - it starts playing god-knows what, so i just close the whole page immediately

well, there's a vague (very vague) similiraty of the rhythm (not the pitch of the notes at all) of your sequence and some deep buried sequence in the commercial song . By this stupid criteria, many '50s rock & roll hits, which had practically the same bass and chords with just a different melody and lyrics, would never had seen the light of day, lol!

I'm finding more and more theres a general acceptance of people who steal creative content on the internet. the big response is, well, "if you put it on the net, what do you expect".. kinda sad in a way. I belong to a relatively obscure site and one individual routinely steals copyright music to sing to without permission. even though its common knowledge he does so, nobody minds cause he has a pretty voice, wtf! if we only worry about our own music and blatantly look the other way when its someone elses, I guess its the writing on the wall. I've had a song stolen and it was plastered all over youtube in a video, I had to fight tooth and nail to get it taken down, was it worth it?
I haven't seen the soundcloud thing but I can tell you, if its downloadable from there, odds are it'll show up on a site somewhere. I don't think anyone really cares anymore, or at least the majority don't

The majority never did care. It's just become harder to regulate them, because it's become way easier for them to copy and then re-distribute stuff.

Yes, if you have a shitty lawyer. Anyone can be sued, and the DMCA overrides a terms of use clause in court. The DMCA protects the copyright of the uploader/content producer, not the third-party hosting the content.

No, they charge you. They hold back on that charge for a certain no. of sales and then they take it, so it can happen you get their notification email 'Ca-ching' and it's all theirs. :^(
