I think that the discussions about SE code in Waves Element and the Xoxos plugin are enough now.

The Xoxos plugin is a sampler/wav player so they are also not really close features wise. I also don't see it listed at the official website anymore:

if it was the other way around xoxos would have got a cease and desist from waves lawyers before page 1 even finished here.

by your reckoning, if i code a synth, i can ccall it ppg or largo or oxium, so long as i make sure the feathures are different? would that be acceptable?

also, i didnt mention, nor care about se code. i do however care about fair play and i feel waves arent really playing fair.

they are both VST's, its pretty simple really

Google search for 'element vst' brings up xoxs as first two results

I don't think "Element" can by copyrighted. Perhaps "Waves Element", still... it differs from "Xoxos Element". But I won't bet on the later if there's a lawsuit going on.

1.) So how do you know they didn't ask at Xoxos
2.) Element is a common word found in a dictionary (it's both a german and english word...) so it could not be copyrighted i guess
3.) There are several plugins that use "PPG" somehow
4.) Oxium is an imaginary name that AFAIK did not exist before.
5.) Xoxoxs element seems to be a Open Source license so i am not sure about the copyrigh
6.) As already mentioned element does not seem to be listed at the xoxos website. The only download link i found seems to be at the KVR database.

Xoxos Element was released at October of last year:

if it does come to a lawsuit, id imagine waves have a lot more power than xoxos. which is a shame and why i feel the need to support him, its not fair that companies with money always win, just because they can afford it.

I think it has to do with Juno word trademarked as international brand. I admit the © and ™ thing is very complex.

From my father real estate experience, it's *always* better to deal an agreement instead going to court.

i don't think the name "Juno" is copyrighted, there is even a movie with that name. It gets problematic if you use the name for a synth and even more if it is an emulation of the real thing.
There is also a brand called Jupiter that produces e.g. Trumpets. They evene use "JP" in their model names:
