Easy. It is a Copy of the software, it doesn't say anything about coming with the USB key. So you won't be able to use it anyway.
(yes I know it is probably a cracked version... the git, I was only joking).

Propellerhead had a raid at ebay last year, and the same user was up & running the day after..
I find it pretty strange that ebay doesnt have any controll over software sales at their site

There will always be freeware so I don't mind if the superexpensive overpriced stuff that some companies put out vanishes because of piracy.
why on earth is it ok for a synth to cost $100+ that has taken maybe 6 months to a year to develop, while a computergame that has maybe 2 years of development time put into it, goes for $45-$50

Because the computer game is going to sell millions of units, and the audioware is going to sell thousands. The computer game publisher makes a hell of a lot more money per person than the audioware developer. While I agree that Ebay should be more aware of what is going on, I don't think they are ignoring it.
I personally have reported cracked software auctions, and went back later to see it was shut down. Also, I made a bid on a video one time, and Ebay emailed me to let me know that what I bid on may be an illegal copy.
Also, Ebay is just a medium to sell things. They have 8 Billion items for sale at any one time, so it would be next to impossible to prevent everything. Software sales is a small portion of what's available. So I don't think Ebay is totally to blame.
I do think it would be a good idea for Ebay to put a disclaimer on every software sale, so that when someone sells something in the "software" category, there would automatically be a notice that Ebay doesn't support illegal software, and to beware and ask questions before bidding, just in case.
It won't stop things, but it may slow it a bit.
