Looks like were not going to get time to do a double take in the chorus.... So I tried adding chorus instead...

So look like this is the final version...

Will give it a download/listen when I get to work. If it's anything like what you posted earlier, then it definitely has a place on the CD. In my play list I put it last so that we ended on an up note. I thought it made a distinctly good close out song.

Has anyone just done a quick check with Chrysalis record company, just to make sure they don't can this whole effort with a tantrum about us using their trademarked name as the name of a recording project?

It's not that I don't like the name - I do like it, but I would hate to see this go down in flames due to their big lawyers having a fit.

I can see where they would have a fit with the use of the name coupled with the excellent butterfly imagery that pHz has put together.

By the general public, it could very well be construed as an effort by Chrysalis records, not this international band of KVR musicians. At least I can hear their lawyers saying this.

A couple other words that might work which would match the Chrysalis concept - if what it means is the transformation of life from a pupa to a butterfly:

Rebirth
Awakening
Metamorphosis
Reemergence

Or Virgin did with Madonna's 'Like a Virgin' ?

Its not a trademark issue, it cant be a trademark issue (the title of an album of music is not what trademarks relate to), and they'd get laughed out of court for trying to claim it was one.

Again, I don't think this is a problem. Song titles, Book titles, CD titles cannot be copyrighted--is that really a word? So, I'm pretty damned sure that using it is totally okay.

Any lawyers here?

As long as we only use Chrysalis and the project title I don't think there's anything to worry about.

I've just managed to upload my song. I have called it Soul Music as a working title but I am open to suggestions for a name. :)

Almost unrelated - PRS just won a case where they were sued by Gibson for making singlecut guitars. Gibson claimed that the customer would see someone play a Les Paul in a smokey bar and run to the shop and accidentally buy a PRS singlecut. They were talking about "initial-interest confusion" and "post-sale confusion" and there was actually a "smokey bar theory" as well.
At first, PRS were told to stop making and selling singlecuts, but an appeal court reversed it.

This is Gibson's attoney talking:
(“You’re dealing with, you’re absolutely right, very
sophisticated consumers here. They’re sophisticated both at the, at looking for that shape, and they’re sophisticated when
they buy this. There’s no question when they buy this [i.e., either a PRS Singlecut or a Gibson Les Paul], you’d have

The court agreed. Gibson lost.

It would be courteous of us to ask Chrysalis, but it's a WORD. It had a meaning before the record label was founded, and after it dies.

I understand that it's not a trademark issue - but with the combination of the name and the butterfly imagery that is being proposed, it could easily be construed that we are trying to capitalize on the existing label's name to give an impression that these are Chrysalis artists doing a charity effort for Katrina victims.

Don't you agree that it could be considered misleading to the non-KVR informed that may happen across the CD?

What if the CD said:

Columbia: Musicians for Katrina Relief

(Columbia being a word that is both trademarked as well as in general use, similar to Chrysalis)

Don't you think that would be confusing to potential buyers? Wouldn't the natural assumption be "Oh, a CD by Columbia artists to help out with Katrina relief"?

I just would like to avoid the potential confusion that may arise with the Chrysalis name. We wouldn't want to see the release of the CD get held up for some silly reason like that, and I'd like to avoid having to explain to friends and family that the CD has nothing to do with Chrysalis records, etc.

That's all. If everyone else is comfortable with it, fine.

You have a point, rockstar.
And I didn't quote the Gibson case to say people who can't see the difference are idiots.

Maybe it's a good idea to choose a name that can't be mistaken for something else.

However, the only place they can get it is at katrinareliefcd.com, right?
So put an explanation there, perhaps?
