This ruling mean precisely f**k all. A sample has to be recognisable for anyone to take legal action!!! If not, how are to know they've been sampled?

Android / Chase,

Certain types of music are based on sampling. No getting around that. I do see any problem with using a sample as your source material so sonic mayhem. Infact, I do this alot myself and really enjoy it.

I think you have to seperate the moral and legal aspects of this argument. Otherwise you'll end up going around and around in circles.

In terms of the law, facts are:

- Its illegal to sample without permission
- Its impossible to get caught if the sample isnt recognisable

Ie, sample all you like but make sure you mess it up beyond all recognition!

I'm not surprised - Obvious abuse of the sampling laws, you'd have to be deaf not to hear the similarities between the original and the edit

Oh, I agree completely. I would NEVER, ever use, like, use a Recycle drum loop, 'cause I can make what I need by myself, and have been for many years prior to all this loop software. But if I need to create, for example, some strange evolving background ambience, I'll take a section of Stravinsky or whatever, and use it.... use it as "seed" material for sound design. Or I could get the seed material from sample CD's, or I could record my own. No difference. That's not sampling "music", that's just grabbing waveforms to use as raw material. That, to me, is way different than grabbing riffs and beats off of commercial releases. To me, that's lame & lazy. But then again, alot of software is sold just for that purpose.....Apple gives it away.

There's many ways to sample. Not everyone that samples uses sequencial notes. The more modern way (thanks to technology) is to sample one note at a time. Why do that? Because on the commerical sample cd's if they have good horns they are too expensive for most people.
It's not as easy as using premade samples. A premade sample will tell you what key or keys you are using....cut it out of an album and you gotta have an ear....so how is that easier?

I defenitely won't throw my recycled drum and percussion loops away, regardless where they're from.

But then, nobody would ever detect the original source anyways.

It's ridiculous... Are they going to retrospective lockup Stravinsky for 'sampling' folk tunes to make 'Rite of Spring' - he didn't even do the intelligent thing and hide the melodies?

Meanwhile in the real world...

If you get caught using an uncleared sample the record company will want a large lump of any money you make.

If you don't make any money they don't care and you won't get caught.

The record companies love sampling. It's an extra revenue stream and it recycles their old acts.

Taking the thing one stage further - I remember reading that Pete Waterman (Twat!) readily admitted lifting phrases from classical music. Question - How quick would you end up in court if you lifted a phrase from any of his tracks. Ho-Hum!

All comes down to ownership, as I said if you could patent the Sine wave you'd be one rich dude.

In an interview for the BBC's Hard Talk series, Waterman used the excuse that he was a good 'Capitalist' no less than ten times, when he was confronted with the argument that the endless turnover of 'drone' girl/boy bands he and the music industry were happy to promote was sidelining real creative talent. Creativity or profit eh!

Has any one seen this yet?
