Just read something vaguely interesting in an SOS interview with Mylo. I have often wondered why people like this only ever credit half the samples on their records - cuz they dont clear them at all the cheap fookers!

Anyway, I thought this might interest some of you - especially the ones who are still to scared to sample a hi hat :wink:

"The album also reveals Mylo to be something of a master of the manipulated cut-up, no more evident than in the distinctive chopped and reshuffled sample in 'Rikki'. "It's a just sample that I chopped up in Recycle," MacInnes explains. "Anything that had any internal rhythm and structure, I kept on putting chops in 'til basically I just had hits. It was probably a three-second loop and by the end I had 25 constituent parts that I inputted into Dr. Rex, the loop player in Reason. Then it maps each constituent part to a different key on your MIDI keyboard, and you can play each little hit in whatever way you want. The sample's not been cleared, but apparently I don't even have to because it's so far removed from what the original record was. However, I don't yet have that officially from my lawyer, so I better not tell you what it is!"

Which he followed with "Of course, my biggest hit was a bootleg of my backing track with someone else's tune, what does that say about my music? That I'm a puffy eyed pretentious c**t perhaps?"

Mylo is an extreme borrower :)... Actually, how much do these types have to pay, royalty-wise? The copyright trail must be a nightmare

Although it can be a notoriously thorny issue, MacInnes insists that sample clearance needn't be as problematic as it first might appear, citing the split-second snippet from Prince's 'Kiss' used in 'Guilty Of Love' as an example. "Even though that's clearly Prince, because it's just one hit — it's a snare and a grunt — it's got no intellectual copyright status of any kind because it's so primal. So even though it indisputably Prince, apparently we're OK, we don't have to clear it because it has no musical content."

The guy had a top fourty album, and says this in an SOS interview - I think you can assume it has a level of truth to it. If not, he is dropping himself in some pretty hot water, is he not?

Ofcourse, if we all sample our own sounds, how will they ever sell us another loops CD? :hihi:

If you sample someone else and make any money out of it then credit the original musician. This isn't rocket science! :roll: No one is going to sue you if you haven't made a brass ha'penny out of a tune you've sampled. Lawyers aren't stupid.

Mylo is just a tad removed from our status, don't you think? So if he's not quaking in his boots then us lot have nowt to worry about.

Sometimes these issues on KVR turn into handwringing hysteria where the only response is, "Get-a-grip!" :hihi:

He's probably safe, but not for the reason he thinks.

There is a difference between what has copyright in theory, and what it is possible to win a lawsuit with.
Mangling a sample does not remove the copyright of the originator, it just makes lawsuits impossible without a signed confession.

...I guess he had better not sign the article.

If someone takes about 3 or 4 seconds of something and goes thru the whole process of cutting it up and rearranging it to the point that it is unrecognizable
why should anyone give a flying f**k if its cleared?

Its hardly in the same league as someone who lifts an entire hook and rides on the success of an already popular tune ala hammer,puffy,etc etc

spending time debating/dissaproving is about as productive as sitting around pounding sand up your ass

well I think that's bull and he doesn't know what he's talking about. He may not need to pay royalties for performing a prince song, but the record company still own the copyright of the actual recording. His record company could make a recording of Prince washing dishes and if anyone uses it without permission they are guilty of theft. If what he says were true, you could sample anything that "has no musical content" and get away with it - eg, dialogue from films - which you clearly can't without getting into legal hot water.
