i found a site that has a few nice hard to find freebies on it's server. i asked a mod about posting it. i got an ok. i asked a dev whose product was there and got an ok. i asked a middle man to a dev about another product and got an "i'll get back to you". still, no answer. anyway, what's the 411 on this?

I guess it's kind of a very-light-grey area. It would depend on what any license agreement texts (if any) that came with the archives said. Beyond that, I am of the opinion that since they were free to begin with and offered publicly at one point or another, they should be freely distrubutable except in the cases of magazine cover cd's or putting them up for sale, etc. If the author contacts you with information to the contrary, simply remove them (which you can't do since it's not your server, but whatever).

I think the important thing is the original developer, rather than a distributor. A distributor will have their own contract with the author, and they might be a little nervous of their market share being taken. However with freeware this shouldn't be an issue. If the originator of the work (that is, the copyright holder of the code) OKs this distribution channel, there's not a lot anyone can do to block it, short of hacking the root DNS servers.

I'm going to guess it's -----------------. They've been around for years with freeware for download. It's hard to say either way. Since they are free and if the license does not explicitly forbid redistribution, I don't think anyone would have a legal case to stop you.

Some software publishers might not like it, but they should have added a stipulation in the license then. That's what those license agreements are for.

Although, one should note, much to the site's disgrace, that they are stocking some plugins which do say explicitly in the documents : DO NOT DISTRIBUTE.
