How come people get away with such obvious and stupid copies and others get sued for more creative use of samples (eg The Verve or DJ Dangermouse)?

yes, that tainted love rip is amazingly vapid....
i hated that Verve song as well though
i think samples can work, but taking a 4-16 bars of a song and putting different words and a few "bing-bang-bongs" and 808 kicks on it does not a songwriter make (cue "I've Been Missing You" by Puff Daddy)

I was standing in line at the local gas station when this song came on the radio.
The youngish girl at the counter was sortof singing and dancing to it.
All of a sudden I realized what it must have felt for folks who grew up in the 60s and 70s hear "their" music being played with some rapper on the top spewing his rhymes.
God, I must admit that song is such crap, I almost started a thread about it that night, but I didn't know the name of the song.
