Yeah, right. So, you're suggesting getting into a contract, but disregarding the element of the contract that displeases you. Well, say I want to buy a software sequencer. Say, I am looking for the best price on it, and decide to order it at some online store. When am I seeing that EULA thingie? In most cases when I try to install my newly purchased software. Now, besides the fact that I am too excited to try out my new toy to read some small written paragraphs in an annoyingly small textarea with scrollbar, let's assume I read the whole shit and decide that I cannot agree to it and cancel the installation. Well, unfortunately I cannot send the thing back either, because most online retailers don't allow returns of software items...

Doesn't sound like a real contract to me.

It's a UK retail thing and nothing to do with copyright.

In most cases of software you don't get to see any contract before buying, so retail contract applies. Only after when installing the software do you get to see it and that makes it invalid in most cases. No aditional contracts can be enforced after the sale because the contract ends with the sale.
If you view and acept the contract first then fine.

@ bullshark This is one time where you don't normaly get to read the contract first, that is what's wrong.

What I was trying to say about elemental audio was that most of their products were cracked quickly

and that may be the reason they sold out and this was done.

And I don't buy software as I use Linux.

I'll concede on one point; the EULA should be more readily available for software products. It should be on the box for boxed product, and/or have a direct link from the product page on online products.

Some developer seem to like to make you jump trough hoops to access it (I had to email Cakewalk customer support to get a copy to read before deciding on buying Sonar producer or not), this is not normal nor transparent behavior.

If that was your point, then I misread your post and I apologize; the more so because I agree that it should be more readily available (see my post above). It's almost as if dev were ashamed of their EULA and tried to hide it.

Just out of curiousity: you got any proof of that?

Depends on your local law. In Germany EULAs can not be enforced, because a click on a button is not considered a legal signature. And I'm actually glad it isn't. I want these things defined by my countries law, and not by some weirdo lawyer from outer space.

Re-selling your software is ALWAYS legal in germany, f.e. - contradicting EULA-statements are not valid over here.

It's similar here, software is classed as a product and is the same as buying or selling cd's. You own it and you have the right to sell.

How did the EULA protect the buyers in this case, they will be dumped just like the PC Logic users were and the EULA says they can do just that.

Buy an iLok, pay for an upgrade, agree to another EULA and then wait to see how long before that company folds!

A0 Parametric EQ
It's not unique, but it works well,and sounds good.
I purchased it years before I got Eqium and Firium,and still use it often. It has been re-released for free, along with a Tape Echo and Flanger.I believe Echo and Flanger are DirectX only. You can find it here

Don't forget Posihfopit. Posihfopit is actually kind of similar (and even superior in some ways) to Eqium. Very powerful Equalizer and rivals payware.

Now that there're a couple of weeks gone since EA was swallowed up, I looked on RogerNicholsDigital apge again, and I'm still shocked by the high price. I mean, it's his thing if the people pay as much for just a new GUI, but the same old engine.

What pisses me off the most, though: Inspector XL.
It's dead, vanished, gone. IMO one of the best metering tools around, and it won't work on Vista in 64bit mode. Wonderful. Which means: Get back to the roots (PSP Vintage Meter), get a DSP Card (Powercore or that other one who has a K-Meter bundled), proper hardware, Penguin Audio (NO WAY!), ...

Unless somebody really takes up the idea of Inspector XL and enhances it like 5x better than it was (for example resizing however I want - hint for Voxengo).

But seriously... as paying customer, this pisses me off. The last upgrade was a joke, then it completely vanished and those "new deals" are a f**king ripoff. It's your fault if you offer a tool for 89USD as "introductionary price" and then don't raise it for almost a year to it's "regular price" of 219USD, or even inform possible customers that your tools even "exist".

Two thumbs down, Elemental Audio. Seriously.

Elemental Audio been swallowed up...
