Some of the license's language looks spurious to me:

"...All copying, lending, duplicating, re-selling or trading of this product or its content is strictly prohibited. ... You cannot electronically transfer the sound samples or place them in a time-sharing or service bureau operation or a computer/sampler connected to a network."

This appears to make digital transfers illegitimate, including moving the samples around on HDD/CD/etc and even the initial download. Furthermore, it prohibits connecting a device/computer/etc to a network if the samples are present on the connecting device. After downloading the samples you would have to disconnect your computer from all networks including the internet to be fully compliant.

And:

"... Only the ORIGINAL purchaser of this product has the right to embody and reproduce the enclosed sound samples within their music compositions. ..."

This seems to prohibit the use of these samples. At least for free. No one has purchased these samples since they are free, so no one has met the "ORIGINAL purchaser" requirement (presumably).

And finally:

"...Opening this product constitutes your acceptance of these terms. ..."

Why such an aggressive license? Is this to prevent people from selling the samples? Anyway, the license never explicitly defines what constitutes "this product" so this only really applies to the license.txt file itself, and I am pretty certain that simply reading a contract can't legally be construed as agreeing to it. In court it would never hold up, but it's scary nonetheless, and considering the other problems with the license, I think it should be reworked slightly before people use or even download these sounds, since the license automatically dictates non-compliance.

I care. And anyone who might use the samples for non-hobby work. Or anyone who wants to comply with the license. And before the flaming commences, I would like to say that the same 'who cares about licensing, just use it because you can get away with it' attitude can be applied equally to sampling commercial work without a license in violation of copyright or stealing apps/mp3/etc, which according to this license is exactly what you did today if you downloaded and used these samples, since you A) didn't buy them, and B) connected to KVR to post a response to my comment/question from the same computer.

Thanks for pointing this out, I did not write the license myself because I don't know d*ck about these things, a friend helped me out on this one. I will contact Creative Commons and ask them for their opinion on this issue. I don't know for sure if I can copy the text from their license I'm using one-on-one to the license files that I zip with the packs.

Yeah! That Westcoast Cruizin one was great! I was very impressed. I've gotten to a point now where I won't download samples anymore (better to mess with a few samples to get a sound rather than search a huge library). BUT, I will definitely download the new Hip-Hop Package because that first one was impressive!

[actually I would download some more samples if it was something I could not make myself, for instance some live brass instruments or some live drummer stuff (difficult to emulate and great for 'sampling')].

I think it's fine to include any CC license. You might want to add something preventing resale and redistribution of the original samples without obtaining a proper license in the form of consent in writing, if you are interested in preventing them from being sold. You should also apply this to derivative works made for use as samples in that case. I would go with something like:

XXX Sample Pack (c) s****r***.eu

The XXX Sample Pack is licensed to persons obtaining
this pack in compliance with this license under the
terms of the Creative Commons XXX license with the
following additional requirements and conditions:

...

i. Resale
You may not sell, or make available for sale XXX
Sample Pack or any derivative work for use as samples
without obtaining a written license from s***r***.eu
granting such rights.

...

I just added a new pack called Trinitite,it's the second part in the Manhattan Project soundfiles

This one contains 50 24 bit mono percussion one-shots and 40 24bit stereo waveprints/impulses of the "ODD" category.

Just another thanks! I got all your sets, and visit your site once every morning to look for new stuff.

I haven't even jammed on your stuff once, haven't had time to play drums, I've been sequencing them.

But there's cool sounds, and a lot of variety.

Meanwhile I'm working on 2 new packs whenever some free time occurs :) Last week I was watching TimeWarp on Discovery and got some inspiration for a new sample pack... So there's more to come.
