What happens if you actually sample a (let's say) violin, and will sound pretty much like a violin sampled by someone else.
Or even more, it will sound like a violin, which keeping in mind how many violins are in the world, it will be highly unoriginal.

A single violin sound is not copyrightable (in general). But a particular recording of it (a sample) is.
