No..when they started selling music Apple Records went after them. Until that point, there was an agreement that Apple could use the name as long as they did not get involved in music. Apple Computers broke that promise with iTunes.. Google itbif you want to know more.
Partly true. As long as apple inc didnt supply music in a physical format they werent breaking any conditions. They didnt and apple corp lost the case.

I dont know why everyone is acting like little girls, who cares if its called element and there is already a plugin called element? There are only so many "normal" words you can name a product, and if they are all used up, what shoudl we do? We cant release any more synths because all the names are used? Should we then start using numbers instead of words?

I think there are different depths to this problem. Obviously you are not going to create a vst called Virus, because Access has that synth and its their only and primary product. You wouldnt call a synth JP-8080 because of the numbers, indicating something from the companys previous line of synths.

In this case, Element does not have so much weight, since its a simple word, and the companies have more products beside this. So in this case it would be like if different music artists use the same title for their track. Or the same title of movies (type in Dracula on imdb).
So basically its two products: Waves Element and xoxos Element. Problem solved.

I like it. Much better sounding, IMO, than Saurus. I want to amend my post. I went back to it today... to find an error telling me I had no license. The machine was now off line... does that mean I have to be on line to use it? No go. A bit later in my session after Live rejected the plug, it crashed twice with some complaints about that microsoft file thing which it's installer updated. This is super rare especially considereing what I was doing. Uninstalled and not recommended.
No problems with Live here so far. Both with the demo and later with the full license after many hours of using it. Got the license on an USB flash drive and it works on my desktop PC and my notebook.
Later when i i use my notebook again i'll try to turn off WLAN to see what happens without internet. AFAIK it should also work without.

Only problems i found and reported are that the Element plugin does not run in certain hosts like e.g. Orion 8.5 demo and EnergyXT 2.6.
Just checked with my notebook and with internet turned off. Still no problems with Element in Ableton Live 8. As already mentioned the license was moved to the notebook using an USB flash drive.
