Found this site. It contains many of the famous classic drumbreaks. Very useful.

But interesting!

I don't think I'm ever going to be in the position of being sued for use of an uncleared sample...

I was listening to "Remember" by AIR a while ago, and suddenly twigged that the drums were nicked from "Do It Again" by The Beach Boys. No apparent acknowledgement...

[edited for excessive use of the word "though"]

maybe it's just me, but recycling old breaks has very little appeal, feels like using a sample CD to me, but to each their own. tho.

yeah, I'm pretty disillusioned with sampling myself - but I love old records! 8)

yeah you can't go wrong with a bit of Glenn Miller and his big band.

the phatdrumloops.com loops mostly seem to be 128k or lower mp3s.

they've got the .wav extension, but if you check the file properties (in win xp right click on the file and go to properties > summary) the data is actually in 'MPEG Layer-3' format.

I've known about and used this site for years.

As for the copyright issue... I rarely use un-edited, un-processed loops. I do, however, *love* editing out individual kick and snare sounds from these samples and then building my own beats in Battery. The quality of the files on this site varies greatly, but it's usually good enough to build new drum sounds from the foundation.

Is this illegal? No idea. Would anyone be able to catch me if it was? I kinda doubt it. Does doing this make me feel like I'm ripping off the artist? Sorry, no.
