This has probably been asked before, but I can't find a definitive answer so far. The question is:
If someone uses a purchased "royalty free" vocal loop with melody and lyrics, combined with an original background, arrangement, etc. how can it be released commercially, either as a song or in a video soundtrack?
What's involved in claiming authorship, performing rights, etc?

Bottom line is you have to check the license agreement directly. If it's not clear, you should contact the loop producer to clarify.

In general terms, "license free" means you can do what you want with it. In the case of longer sample material, there are often attribution restrictions included in the licensing.

I'm not a big loop user, but what I wonder about is with the crazy infringement lawsuits these days, it seems juries don't really understand these things such as royalty-free loops, etc., so if they hear two songs with the same loop/beat/whatever, they may vote accordingly.

What I'm really asking is this..if you write all the instrumentals, arrangements, harmony, etc and put a loop of someone singing lyrics, surely you can't claim the song as fully yours, as u didn't write the melody/lyrics.
If you register it with ASCAP or any performance rights organization, I imagine you would have to include
the composer of the vocal loop no?
I wrote to Black Octopus Sounds for a clarification of this, but have not yet heard a reply. ..

I heard back from Black Octupus Sounds..basically they said:

"you do not own the vocals (other people will be using the same samples of course) but you can freely sell the song on digital media & register the song with Socan (Canadian ASCAP) with claiming 100% of the royalties".

Now that's royalty free! I don't know if it's the case with all companies, but in this case it is..

Makes you wonder if there are any cases where 2 different artists have the exact same sample-pack vocal loops in their tracks?
