Attention, Synths-presets.com does not allow license transfer!

I wanted to sell my presets from synths-presets.com together with my Valhalla Plate plugin and posted it on KVR.
Then I received the following message from Synths-presets.com (Steve WZ):
„Distribution of copyrighted materials - Official Notice
Remove your post immediately
As stated on our website AND included in the downloads we sell:
We use the standard policy for digital media.
As digital media cannot be returned, once it is downloaded there are no refunds.
We always offer audio demos of all products.
We sell licenses to use our product by purchaser only.
They cannot be distributed or sold and we retain ownership and copyrights on all products.
Sent to legal council for monitoring“
Sorry, I really wasn´t aware of that and thought it was a very rude and excessiv reaction.
However, I removed the post immediately.
If you´re looking on the website of Synths-presets.com it is hidden very well in the terms and conditons. Not very customer-friendly.
For me personally I´m through with Synths-presets.com.
In this respect I ask myself wether presets from third part plugins are eligible for licensing at all?
And if so, you can never use the same preset without buying it from any licensor?
I think that would be really crazy and I can´t imagine this could be legal.
What do you think?
And is there anybody who knows about this legal situation under US American law?

Any digital products that do not have copy protection would have that clause. Presets, sample packs, kontakt instruments (non-kontakt player), etc.
When you sell the presets, there's no way to tell whether you really remove the presets from your computer or not. That's why they don't allow it.

This is a standard policy.
Essentially, every seller on KVR has some kind of policy to protect their products.
The one is general for presets.
I have purchased several sound-sets from these guys.
The policy was always obviously placed in the instructions.
It is also listed on the website.
Furthermore, the quality of the product and support has been excellent always.
My recommendation would be to maybe next time, read the instructions or if in doubt, contact the seller if you have questions.
It just makes sense....

It's all been said, but I've never seen preset packs with a return/resale policy. You treat them like a cup of coffee.

The terms of service was easy to find.
It was listed on every page of the website, including all the products and the shopping cart.
Then I checked the account section and again, it was listed on every single page including the downloads.
So placing the blame on the seller for making the term's of service"...hidden very well"... and..."Not very customer-friendly.." is complete BS.
Why in the world would you make so much effort to bash a good companies name with such a lame post (several), and absolutely no effort to check into the TOS before selling their products on KVR.

Yeah, StevieWZ from synth-presets.com was not very nice to you. Is this the way to treat its customers?

Its pathetic you want to use this forum to be as destructive as possible to a respected company.
The questions that comes to mind are:
How old are you?
Did you actually buy the product to begin with?
Does mommy know you are on her computer?

This is an odd thread.
Been buying presets, soft synths, samples, etc for more years then I can remember.
I am more then happy to support these designers/developers and respect the copyright.
Strange to see such a blatant attempt to discredit a developer for having a copyright.
Makes little sense.

I think the OP was upset that the dev threatened of resorting to legal measures,
when he could have simply said, I'm sorry, perhaps you are unaware of
our terms of service, but we do not allow transfers.
I don't know of the full exchange, but I would agree that that kind of response
would be counter productive, and offensive to a customer who truly was unaware
of the policy. Of course, a sterner warning would be warranted, if met with
resistance after the initial "friendly" exchange. "sent to legal counsel for monitoring"
is definitely "NOT" friendly.
TOS agreements are enforceable, but really, the only realistic recourse on the part of
the dev would be to deny service, and maybe get a cease and desist if the OP persisted.
Pursuing a civil case would cost a lot of (for all intents and purposes) irrecoverable money.
Even with the "shaky" click through acceptance of the terms on the part of the customer.
My 2 cents, (not a lawyer). But I did spend years working with them in mostly an oppositional
capacity. More often than not, "successfully" I might add.
