This is exactly what a license is made for. If you licensing a product or a techical device or whatever,
no one in the world can copy or use it without a license. That´s the meaning of a license.
So if you want to use the same preset like synth-preset has created, technically it would not be allowed without a license from them. And in this case it would be really absurd and impracticable.
Licensing must have its limitations and this limit has been exceeding imo.
But I´m not familiar with the US Law. That is the reason why I want to have clarity in this legal issue.
I hope my intentions are clear now.

The odds of you creating THE EXACT preset is HIGHLY unlikely.

If it was to happen, once, out of the thousands of presets a company releases, who would care.

Your right, you are not a lawyer and in reality don't really care about that (your not posting in a legal forum).

Lets be honest, by looking at the title of this thread it is easy to see that your motives are.

Essentially, you are using KVR to attack a reputable company under the premise of legal interest.

Its really juvenile and pathetic.

I thought the issue here was about transferring a license, not about what a license is for. If transferring the license is not allowed by the developer, and its clearly stated in the EULA, you are not going to be able to transfer it, whatever your opinion is.
