Still available for free, exactly where? Is that the original publisher?
Me thinks Fairlight does own the rights to these samples, but just doesn't excersize these rights. Just like none of the rightfull owners took action on the Amen Break.

And yes, it's the original "publisher", AFAIK (whatever that means - they didn't regard themeselves as "publishers" then, as Peter Vogel explained). And they don't own the "rights", as Peter Vogel clearly said in the video posted. The vast majority of the samples aren't even their own - they come from users around the world, and were shared for free to other users through Fairlight.
Probably because the policy changed in the meanwhile, the Fairlight III library is not available. I presume that's the one is not completely cleared.
I'm not defending that everything should be free, or is free by definition, but I have seen several libraries being sold based on the Fairlight sounds over the years, and the issue was never raised. Since I am also thinking in assembling a library for TAL Sampler based on the original samples converted to a more modern format and in 22K, I would like to have this cleared without doubts. But, if released, my library will be free, therefore, at least I could not be accused of profiting on the work of others.
Anyway, Fairlight doesn't exist anymore. I would like to know who bought/inherited the Fairlight existence and rights. Someone does, and isn't even Peter Vogel, because he was forced to change his new company name precisely due to rights issues.
In his site, there is this footnote: "Fairlight is a trademark of Fairlight.AU Pty Ltd and is used by Peter Vogel Instruments Pty Ltd under licence. There is otherwise no connection between the two companies. To visit Fairlight.au go to http://www.fairlightau.com" - However, that domain is also dead now, and we are redirected to the site of a company called Blackmagicdesign, who produces film and video related stuff. Maybe they are the owners of the trademark now - that's what I would like to know.
But there is more. Peter Vogel Instruments also released the Fairlight CMI-30AX. This is being sold with the sound libraries of both the IIx and III included. But in the site, it's said that "We are presently negotiating with influential early users to include their libraries too." This means that they didn't need to negotiate anything for the included libraries. Yet, the only mention to licenses is the same one about the name: "Fairlight is a trademark of Fairlight.au Pty Ltd and is used by Peter Vogel Instruments Pty Ltd under licence. There is otherwise no connection between the two companies"
I presume that, if the company who licensed the name would have any rights to the sample libraries, that would have to be mentioned too. But all this is just guessing.
Just in case, I e-mailed the PR guy for Blackmagidesign Europe. Let's hope he answers me.

I was allowed to use the samples (which are in fact not available anywhere else as these are taken from the output of a physical IIx and not just converted or anything like that) in communication directly with Peter Vogel AND Fairlight — and after demonstrating how I would use them they also were very enthusiastic about this happening. This is also not only a Fairlight library but a library that has grown as I have added lots and lots of other things and lots of custom programming & sampling.
It's sad to see attacks like these as I make a really professional and cool library.
The focus should really be:

Taking care of copyright issues is part of the sampling business. So you should be prepared on people asking this type of questions. Maybe spend a paragraph on it on the product page, just to avoid questions and provide some providence on the origins of the recordings you used. Nothing wrong with proving your sources aren't dodgy!

The issue is that this customer has been given three different links saying none of them works although they worked fine here.
