No demo, refund and even NFR of some orchestral libraries - is that legal?

No possibility of re-sale is a bad thing. Companies prohibiting that should be avoided, too much risk is put on paying customer.
I don't understand such overcriticism of OP. Everybody can do a mistake. Don't anybody here has expensive toys hidden unused somewhere on hard drive? There are a lot of details you can honestly miss or over-expect reading bold marketing statements. There should be a chance to recover from mistake at least partly.

Well, the OP has answered few if any of the questions asked including those of posed a solution besides - after downloading a 50gb library that he should be fully refunded or that you should be able to fully demo every Kontakt library available.
OP bashed Spitfire because of not reading EULA - FACT (I'm not knocking you for not reading it as I rarely do...but I wouldn't complain about it after the fact)
OP implied that they have falsely advertised library - FACT
Not one person answering if EW falsely advertised their library - FACT (I'm not saying they did, I'm just asking if it could be possible based on your opinion of the library description)
My care level for this thread is dropping - FACT
My cravings for a BLT and a drink have increased while typing this - FACT
I get making mistakes. My god, I have made A TON of mistakes as I said earlier. They have been with synths, libraries, effects, loops, game purchases, finances, letting my snowblower run out of gas, thinking it was a good idea to eat an entire wedge of Cambezola in one sitting, etc. It has never even crossed my mind to directly blame a company for my mistakes...If there is not a demo, do all of the stuff listed in the thread with videos, reviews, etc. If that isn't enough, don't buy the product on chance or actually contact the company prior to purchase. As others have posted, I will generally do research before purchasing a $10 plugin...
I guess I just don't understand the OP's (or other people posting) rational for why y'all are continuing this thread with excuse after excuse without answering any legitimate questions or posing solutions that would actually be feasible.
I personally don't think having a full accessible downloadable demo is feasible but maybe I (and a lot of sample library companies are idiots). If so, I would need another harddrive for 8Dio, Spitfire, Soundiron, ER, SAM, Vienna, Cinesamples, Berlin, Sonokinetic, Heavyocity, Sample Logic, etc. demos.

Yep, OP should avoid them and as a consequence it would spare us another stupid pseudo topic.stacev wrote:No possibility of re-sale is a bad thing. Companies prohibiting that should be avoided, too much risk is put on paying customer.

Or he could simply contact the guys because point 12 from Spitfire's EULA says:
Refunds. Due to the nature of downloadable products and online services, no refunds are normally available for Products which have already been downloaded. Any refund request will be considered in our sole discretion and our decision will be final. Nothing herein affects your statutory rights.

When I read your comments (sorry one comment over and over), I can see mostly statements about you however you and your feelings do not matter. Your care is dropping, great, finally. You drink more because there is not enough attention to your smart opinions, oh sorry. Moreover you still use unfair things to support your truth as I did not take care about developer's falsely advertised features. Just fyi, In my reaction I wanted just explain to someone there, that there are many parts in the product description that could be understandable differently by many users and therefore they are not very valid for proper decision making process.dandezebra wrote:Well, the OP has answered few if any of the questions asked including those of posed a solution besides - after downloading a 50gb library that he should be fully refunded or that you should be able to fully demo every Kontakt library available.

Next I do not care about EastWest and do not care even about Spitfire (this is the reason I mentioned it only in the beginning of the thread as the developer I dealt with) as it is not important. This discussion is more about the general rules you see acceptable but which are unacceptable for me (may I have different opinion as you?).
Full accessible downloadable demo is no issue at all. The only problem is that many developers are not willing to pay costs for such services. Fyi today I downloaded and now testing Steinberg Halion Sonic 3 - 28 GB library, download time 2 hours, full version demo for 30 days with zero issues.

Thank you for the tip, I contacted them next day after purchase and downloading. However they just re-read me this part from EULA and said good bye.murnau wrote:Yep, OP should avoid them and as a consequence it would spare us another stupid pseudo topic.stacev wrote:No possibility of re-sale is a bad thing. Such EULA is like piece of shit. Seller literally tells you that you are an idiot because you downloaded the product you paid for without proper trial and you can solve all possible complains with yourself.

Again though, did you consider contacting paypal or your credit card company? I have found that vendors are more willing to bend policies when confronted with the alternative of additional costs. On more than one occasion when I've experienced the "policy wall" I've simply said, "ok, I'm dissatisfied with this product and I'll just take this up with my credit card company and see what they have to say about it." In some cases the vendor changes his tune, in other cases, the credit card company goes to bat. Now, I can't say that I've dealt with exactly this situation, but I wouldn't be surprised that a business doesn't want to bend policy just on a request.poshook wrote:Thank you for the tip, I contacted them next day after purchase and downloading. That said, regardless of what people think of who was wrong and who was right, it's useful to know that Spitfire doesn't bend policy without additional leverage.

Paypal disputes would be useless in this case. Spitfire (or any other sample lib developer) would just say the user didn't read EULA, point to their website with video walkthroughs etc. showing how library works and how it sounds... the user cannot ask for a refund on basis of "I don't like this library", or "they falsely advertised it", or "I don't even know how to use this" (that one's priceless!).
I've had several of those PP disputes when dealing with Hollow Sun. In light of evidence, Paypal always decided to seller's advantage.

That may be true, but you wouldn't know if you didn't try. Moreover, there is something to how the argument is presented both to the seller and to the credit vendor. Like I said, I have not dealt with this specific situation, however, I have had disputes resolved in my favor even in the face of policies that seem as open and shut as this.EvilDragon wrote:Paypal disputes would be useless in this case. Moreover, I wouldn't expect that it's in any vendors business interest to state anything to the contrary on a forum like this.
In any case, this is why I tend to not use paypal for large payments but use my credit cards directly. I really can't speak to the effectiveness of paypal disputes as I've had only one, resolved in my favor, for an egregious violation. Credit card disputes, however, are a somewhat different matter and in my experience firms try to avoid dealing with them. YMMV and all that.

Sorry if I have missed your answer, but exactly what were you expecting and did not get? If the Spitfire web site lead you to those expectations and they were not delivered then you would have a case for a refund.poshook wrote:Just bought Spitfire Albion One, download and install. If you were misled, then, in the UK, you can pursue a complaint through Citizens Advice / Trading Standards:

we are talking about current rules where developers do not provide proper demo, refund or even resale.
It is not focused to Spitfire or Eastwest but orchestral libraries developers in general. I see these rules unacceptable as there are many audio software developers who provide demo and allow resales. So the question is, why library developers are different.

Did you mistake me for a bunch of others who actually called you names, mentioned a tantrum, etc? Huh? My apologies if you actually took so much offense to my previous posts that it warranted your reaction.
At least you managed to ignore the multiple other people who actually have directly insulted you in this thread. Ha again!
Halion Sonic 3 is the same as a Kontakt sample library?
If you do not care about Spitfire or EW, delete your references to them in this thread.
Were you able to demo all of the samples and libraries fully on your 2 tb drive?
Also, saying the same thing over and over? Sir or Madam, I do not remember mentioning Cambezola multiple times in this thread. Do you have a hatred towards soft cheeses rippled with blue?
Anyhow, I wish you the best of luck! I sincerely hope (AGAIN, sorry to repeat!) that you actually find some time and enjoy this beast of a library. Or do a Paypal dispute, try and get your money back because of a mistake. Whatever.
Anyhow, please edit your previous posts or lock this thread and start another one without complaining about your specific example if you are genuinely attempting to solve the problem of a plethora of Kontakt sample library developers having their libraries as NFR and not returnable. Or at least try to respond to actual things people have posted. Or come up with a feasible solution as to how one company's sample library (lots of open-format wav) could be demoed on another company's sampler. Halion 3 does not seem like an apples to apples comparison besides the size.
Or, insult me again and not the people who actually insulted you. It would make me sad and teary I guess if you went that route, however, if you need the last word about this...
Good luck and cheers! Also, apologies again for posting all about me.

we are talking about current rules where developers do not provide proper demo, refund or even resale.
It is not focused to Spitfire or Eastwest but orchestral libraries developers in general. I see these rules unacceptable as there are many audio software developers who provide demo and allow resales. So the question is, why library developers are different.
It's been explained over and over but you don't want to listen to the answer. It's because the balance of risks, costs, and benefits is such that is not worthwhile for them to do so. Creating one thread on KVR is probably not going to change the risks for them.
Trying to argue that, on average, that the costs and risks are the same as other music software is not supported by the evidence given other similarities.
In short, they don't have to provide a demo to run a viable business because the vast majority of their customers accept the basic explanation that their costs and risks of doing so would be larger than other similar sized businesses.
You can certainly find exceptions, but it's unlikely that you will find identical properties between the firms involved.
What do you hope to achieve with this thread if you don't wish for your own problem to be solved and you don't want to badmouth Spitfire? There's no secret to uncover, there's nothing insightful here. Everything that you need to understand the "why" has been discussed already.
