sample licensing

Just wondering if any of you have checked all those licenses you get when you purchase a sample cd etc..
i'm busy reading all of them because i noticed some let you use the sounds...
anywhere within the context of a musical composition..
or others might say.. yeah. TV and film is grand but you'll have to pay me extra if you want to use the samples in games ..
is game music not considered musical compostion? to my knowledge the pay is not any higher for games than it is TV or film
why the clauses...
makes me worry actually.. i don't want to get in trouble

Some game producers have bigger budgets than movie producers. Maybe that's an answer...
Other than that, music is music indeed and publishing through a video movie or video game is not that different.

i'm the one buying the libraries .. i know i'm not getting paid any more than film composers..
so i doesn't seem fair that i have to give an extra percentage to the sample companies after i already bought a license..
maybe i'm too low down the chain.. one day i can afford to use the samples i spent my money on
for now .. those that ask for extra money to use in games .. well i can't afford to use them. simple as that..
this isn't all sample companies mind.. some are fab
and agree that once the license is bought i can use them for a games score..
i'd be right up a gum tree without them..
but...

This is a guess, but maybe it has to do with the fact that individual samples in video games/interactive entertainment can be used as elements in the game. Like sound-fx or loops in a Rhythm/music game that can be soloed and re-recorded by the users thereby compromising the intellectual property of the original sample CD in the eyes of the sample production company.

It's bull nevertheless. When I buy sample-cds I expect them to be 100% royaltyfree, with no strings attached. Thanks for the heads-up, I'll be sure to pay more attention to the license from now on.

i have written to spectrum to ask about the spectrasonics titles..
these are one of the samples companies i am really surprised at when i read the license..
i've not heard back though.. so i'm kinda hoping he'll see this at some point
What i read when i see the Spectrasonics lisences is that they seem to say i cannot use them in games score compositions..
it is a great dissappointment .. these libraries cost hundreds to purchase them..
then i can't use them.. i feel like i'm being discriminated against just because i am working in the games sector
also the amount of people that recommend titles like these.. well i cannot imagine every single person is paying extra..

Your'e spot on. They dont' want whole loops or single sounds used as sound effects elements. As long as you use them musically, you're fine, even with video games. I've asked Spectra for permission and got it without any problems. hope you're feeling a bit better soon.. and glad to hear you getting back into writing again.. you're a talented soul.. it would be a shame to not use it
