Every time this issue has been discussed here in the past, the consensus has been that the answer is no -- unless whoever owns rights to the software has explicitly set it free.
The bottom line is that whoever owns the rights still owns them, even if they're not currently selling the software publicly.
I'm having a nostalgia attack from your question, because it was one of my first KVR posts in the early 2000's, and I got shut down pretty hard for even thinking that thought aloud.
Best to let the dead things stay dead, and be lost in the mists of time.
