At least there is some similarity in groove so you could maybe see the case. I thought the blurred lines decision was worse though. Basically the decision was if your backing tracks sounds inspired by someone else's music we can sue you. Doesn't matter if the melody and chords have nothing much to do with each other.

I seem to remember the Prodigy doing something like that. They had sampled the Jedi Knights (the musicians) and when this was pointed out to them they bought the rights to the original sample the Jedi Knights used in order to avoid a court case.
