There are two different types of use:

1. You use the sample library to compose and produce an entire song.

2. You use the sample library to create a slightly different, "own" sample library.

(1) is allowed, including commercial. (2) is not commercially allowed.
(2) Unfortunately, you cannot offer it freely on forums or on the market either.
However, you can of course do (2) for yourself personally.

You can legally use the ones that are legal for you to use.

But not the other ones.

Im afraid you're not correct here. What you're allowed to do with a sample is entirely defined by the license set by the copyright holder.

So its entirely possible you may not be allowed to do (1) but can do (2). Or you can do both. Or neither.

So for example, with regard to (2), I own sample libraries where I am licensed with the specific right to sell my own variations of those libraries. I also have zero-cost samples which fall under creative commons licensing where the licensing allows me to redistribute the original samples exactly as they are.

I get the impression using pirated software to mangle copyrighted samples probably fixes everything..

the OP was surprisingly non-specific with his question; is he talking about samples he's sampled from records, or samples from purchased libraries?.. what does 'when solo-ed' mean?

Anyway, 2 wrongs make a right - that's all we need to know :hihi:

Haha, Have you read the terms and conditions?

In particular, I haven't read the above samples either. But I can
tell you: In 99.9% of all terms and conditions, the rights are
regulated exactly as I have described. :)

Suppose I use a library of samples I bought: no problem.

Suppose I find the original source recording of those samples in the library, and use that. Big problem, since I did not have clearance of the samples.

thanks a lot guys, yeah of course you cannot get sued for using simple 909 drum machine samples etc. but woah i didnt know about single snares, hihats etc. in the trap genre the snares can sound all the same :D i dont think anyone made them from groundup... so if i layer 3 different samples and someone samples my super unique layered snare i guess i can sue him?

The messy part is when the sample library contains single hits from commercial songs.

You may think you're clear since you're a license holder of the sample library, but the sample library itself might not have been cleared. Then what?
