We were lucky enough to not have to migrate subscriptions. If you go for a new merchant of record, they may be able to help you with this.

So they don't know if they can keep their own deadline for September 30 ("Statement Day") for the August report?

I find this alarming if your financial existence depends on prompt payouts. Shouldn't a payout for August be due on Sept 01? I thought it was a digital company, with automatic processes, so no human would actually need to do the math. If a business is holding things back for one or even 2 or 3 months, then what are they doing with your hard-earned money? Is this legit? Are there clear terms in the contract stating that this can happen?

I believe they are now saying that it always was a 2 month delay in the contract, and they are are now sticking to it properly. I can't find the email now, sorry.

But that's not what the contract says that they refer to. If they say it's always 60 days, regardless of when the statement comes, they're just wrong.

"Within 30 calendar days of the end of each calendar month (the "Statement Date"), Digital River will provide a statement [...]"

I see two ways to read this.

1) "Statement Date" equals "the end of each calendar month". That would be the last day of the "Pay Period", as that is what that month refers to. This is what the date on the statements always was, even though the statement itself was issued a few days later.

2) "Statement Date" equals any day "Within 30 calendar days of the end of each calendar month", which coincides with providing said statement. In that case, it's as always been fine to issue the statement on the 8th of the following month, and then "pay within 30 days", which was always fine on the 16th.

I see absolutely no way to twist this into "in context of the first half of the sentence, calendar month is the Pay Period, but in context of "Statement Date" the same words (calendar month) refer to the following month.

(and also, it is moot for anyone of us who have a prior contract that explicitly sets a payment date of the 15th or so of the following month, without referring to any further terms that they can change unilaterally)

Well, they can't possibly set a deadline (December 31st for us) and then causally mention that the deadline has somehow moved to "now". Particularly for information they already have, and which can be verified easily through official documentation.

Same here. No payment since July, no August statement, either.

Their support announced the payment to be performed "until the end of September", which hasn't happened until now and which I doubt will take place today. So we're still waiting for the payout of our July revenue.

The new master service agreement, effective on October 16th 2024 states new and additional fees such as a $100 USD / month platform fee as well as $20 per chargeback or $185 / hour (!) to for using their Tier 2 support.

This is all very alarming to say the least. So we're actively looking for an alternative service provider. Probably Cleverbridge since they are located in Germany, too.

Having to migrate existing implementations that depend on MyCommerce's APIs isn't a particularly lightweight task for a small company :cry: .

EDIT: Okay, the August statement came in just now, let's see how it goes regarding the payout.

We just received the Payment Report for 31-AUG-2024 from September 26 today (September 30). Anyone taking bets if we will receive the payment and when?

Payout should have been today per the agreement terms. I guess they won't pay at all.
