There's not no chance. In this case we can show how the early communication was designed to appease us, when bringing in a corporate wrecking ball was clearly in place to to deal with struggles. Like, our handler told us that they had big plans for MyCommerce yada yada. So if that's the case and they fold, they'd clearly be lying to us in order to extort more money. For such a scheme, the owners and CEOs become personally liable in Germany. So we take what's owed from them and their other companies.

I still find it strange that searching the internet this forum topic is the most active place talking about this.
Vendors using DR are probably software developers. A computer literate bunch of people perfectly capable of going online and talking about this. But, for whatever reason, it's just us few people here talking about it.
OK there's some sites talking about layoffs. But business lay off all the time.
Is "Every" MyCommerce vendor affected or just us few here? If it's everyone then where are they?

Hi Urs,
I wonder, though, how things would pan out given the intricate company construct where responsibilities can be shifted around ad lib.

Best,

I'm not a lawyer but I am aware that there's such a thing as "Durchgriffshaftung" that despite the limited liability in theory could be applied to prosecute those in charge in the GmbH portion that we signed our contract with and which is responsible for the payouts, yep.Urs wrote: Tue Oct 08, 2024 7:55 am There's not no chance. I’ve been through a Chapter 7 in 2004, in the American studio people were asked to leave by armed guards. Here in the UK studio we were told to take office computers home as a kind of pay. No-one got paid for their last month.
From that layoff’s discussion (https://www.thelayoff.com/digital-river), it looks like people had no severance pay at Mycommerce. But I don’t know if that's just a rumour thread.

I know about a dozen or two I'd say, and they are all affected.IaES wrote: Tue Oct 08, 2024 9:01 am Is "Every" MyCommerce vendor affected or just us few here? If it's everyone then where are they?
There's also now several posts on LinkedIn, with comments by others in the same boat.
Oh, and more executives have left, as one of them posted on LinkedIn, and they changed the website again with just two execs left:

They even took Murray out of there who I presume is still CEO of the German company.

I've accepted that the last 3 months of money are gone. I sleep better now that I've accepted that. If I do get anything out of it that's just a bonus.
But this whole thing is kind of making me think. I've been doing it with DR, and other MoRs for over 20 years. Not earning loads but I've stuffed as much as I could into savings. I'm almost 70 years old. I've been kind of semi retired for the last 5 years just doing enough coding to keep my apps working. ie bug fixes with no real enhancements.
I'm gonna hang up my keyboard. Just put paypal payment links on my sites and buyers can take it or leave it - maybe next year I'll make my apps into freeware and I'll just live off my pension - only downside I see with that is if I live another 30 years I'll be broke

If it’s bankruptcy, I don’t think it matters.Urs wrote: Tue Oct 08, 2024 9:15 am I presume that people who are kicked out with no severance pay will make good witnesses.

It matters if the bankruptcy is deliberately invoked as a means of scamming us out of our money. In that case the "limited" in "limited liability" disappears in Germany.

Maybe us vendors could contact (anonymously?) all the customers who bought over the last 3 months telling them to initiate chargebacks on their payments because the company they bought from is unlikely to exist for long.
Won't help us but it'll piss of the DR people.

I wouldn't recommend it. It would probably be a violation of contract from your side which they can probably hold against you.

Anonymously.
For example this forum supports audio related stuff. It is possible that some people who are users of your apps - ie not developers - have read this thread and have already begun to initiate a chargeback.
I wouldn't post it on my own support forum but there's other forums and social media where users go. Word gets around.

That doesn't help anyone and only annoys customers. It makes more sense to take legal action if the payments are not made soon.

Customers should be annoyed. Their supplier is DR. DR's customers were lied to as much as we were.audiotools wrote: Tue Oct 08, 2024 10:45 am That doesn't help anyone and only annoys customers. It makes more sense to take legal action if the payments are not made soon.
