Rallying Vendors Affected by Digital River Payment Issues for a Class Action Lawsuit

Dear fellow vendors,

I’m writing to express my deep disappointment with Digital River and its handling of payments owed to vendors. My company is owed $30,000 for sales dating back to July 2024. Despite their change of payout terms from net15 to net60, payments remain overdue, and communication from their support has been vague, very generic, and mis-leading.

I know my loss is relatively small, but from what I've seen in reviews and reports, I am not alone in this situation. Many of you may have lost much more, and it's clear that Digital River’s actions could warrant a class action lawsuit. While I am not in a position to lead this effort, I encourage those who are facing similar issues to consider joining forces.

If you are interested in banding together to hold Digital River accountable, please feel free to reply to this post. Together, we can explore the potential for legal action to recover what is rightfully ours.

Someone suggested submitting the complaint to Public Prosecutor's Office in Cologne, which looks like a good idea to start from. Considering the possible fraud and the total damage, the official investigation would most probably be initiated immediately, and there will be no costs associated with the process for those who filed the complaint. That's the fastest way to start.
Mind an important rule: for any authorities to be envolved, someone needs to fill the official complaint (preferably from Germany, where the HQ is; involving the US authorities might also be a good idea). A short email sent to the official contact address is enough. Otherwise, nothing (officially) had happened.

I completely agree with your assessment. Given that Digital River's website is still operational, it seems likely that customer payments are still being processed into their accounts. Unfortunately, they are not making payments to merchants.

It's better by someone in Germany, where Digital River's headquarters are located.

Let's move forward with this approach.

At this stage, there is no criminal offence, other than suspected delayed declaration of insolvency (Insolvenzverschleppung) perhaps. So nothing the police would care about.

Digital River was owned by private equity company Siris Capital. https://siris.com/portfolio/digital-river

One would assume that Digital River GmbH would be owned by them as well, although I see this note, "July 17, 2017; Digital River Enters into Agreement to Divest World Payments Business" ... who knows what that means ...

Please count me too, I'm in the same boat. Using MyCommerce for 19 years (joined Oct 2005) and had no problems until now - but nothing received since July, even after all data confirmed, documents sent etc.
Not sure what to do, especially from a different country... :cry:

Please consider some additional information regarding Digital River and Barry Kasoff:

1) Part of deleted review of Digital River, posted on 25 Sep 2024, that was indexed and cached by google before it was deleted. (can not post link due to spam filter)
"Pros. Prior to the sale in July 2024 to Barry Kasoff (Realization Services liquidator - research this), DR was a progressive and flexible work environment with good perks and friendly colleagues. The company is now in flames as we lose more employees, clients, and vendors every day. Cons. Digital River is in the process of shutting down in phases while misleading clients and employees to stay for a few more months while the owners get paid out - half the company was eliminated in July/August and the remaining employees will be let go in waves as additional clients are terminated and departments are eliminated. Many vendors are not being paid and clients are up in arms that their funds are frozen. Show more."

2) One of Realization Services company activity is assisting in company liquidations.
3) Barry Kasoff was appointed as director of 6 companies in UK just before their liquidation. (can not post links due to spam filter)
