We plan on doing the following:
1. We send a dunning letter by post as registered letter, so we know delivery. That one asks for getting paid by end of month.
2. Since we expect that letter to be ignored, we will then do the Mahnbescheid (default summons). We need to first send the dunning letter for this.
They may ignore it (Which means they accept it by default) and if nobody works there, that may be the thing that happens.
If they do nothing or accept it, we would send the Gerichtsvollzieher (bailiff). He will probably not find anything.
If they dispute it, we could sue them.
3. We will probably in parallel do a Stra.fanzeige (cr.imi.nal compl.aint) to re.port that they don't pay their sup.pliers and point to the VAT fr.au.d they probably make, if they receive VAT refunds, but don't p.ay the invoices.

The key thing is that we want to get them into insolvency officially. Best if the government starts it as that doesn't cost us money. In that case the court takes over and they may try to reserve some of the ways DR moved money away, so there may be a chance for us to get some cents back on the dollar after some time. Unlikely that we get anything as tax, salaries and other things may get higher priority.

Count me in. ISV, located in the Netherlands. Have been with MyCommerce/Share-it since 2004. $15000+ revenue withheld by them since July.

True, slowly it smells like "Insolvenzverschleppung" (illegal in Germany) ... or the brutal way to force clients to accept new contracts.

To the guys who ask what they do with the money while they receive earnings at the same time (percentage of the turnover): Most likely they invested all of the money during the period between the cash coming in and the date when it's due to pay to you - the devs. That's what not only banks do with your money when they act as a middle-man.

If those investments fail 'bigly' (orange talk) they run out of money. Your money.

I'm also waiting for the payment, that we will all never see :? I can read a lot of comments but nothing official, so i contacted a lawyer today, with team in Germany (my company is located in France).
I asked him to get official status of Digital River GMBH in Cologne, if the company is already unregistered/bankrupt then we can have an official document to present to our accountants, that's the first step.

I will publish here when i receive an official answer.

I tried to order with a VPN in Canada, Autodesk is still selling through Digital River

Autodesk is a large firm, DR cannot screw them as easily as us. So somehow DR doenst' have plan to go bankrupt, or at least DR North America. Is there anyone from North America impacted?

What surprises me is that large corp like Autodesk agree to continue working with notorious scammer like DR?

Yes, the platform itself still works perfectly.
Also for the ones that don't get any money anymore.

Maybe their plan ist to get rid of all the small ones anyway and take their money to cover the dept. That's maybe also why they don't care AT ALL that all these are leaving now.

For information last week, from the MyCommerce control panel, i requested 2 refunds ($1,000 each one) to see if they will do it, today my customers have received the funds, so refunds are processed!
That's very strange that DR doesn't communicate if they continue to sell/refund/subscribe the products!!
