Reguarding the indemnification. The indemnification and limitation of liability is more than copyright claims but it covers that too. You are are agreeing to indemnify ReFX against 3rd party claims, meaning you would represent and be legally obligated to represent yourself and on behalf of ReFX in a law suit that is brought to court.

Reguarding the derivative works term. This is to protect ReFX intellectual property of their products and works. You can modify any Nexsus preset or patch but you may not distribute it, you can modify and use it in your music products as you would not be distributing ReFX the Nexus 5 synth, it’s programming, or sample content or preset rather a audio file of the sound. This is to protect RefX samples, patches and they don’t want someone selling or distributing them without ReFX consent. Make music, don’t give their stuff away, pirate it, or make other stuff for another synth with it (like using the samples for something else.

Pretty standard language all around of IT companies terms and conditions, nothing really out of the ordinary. I read/negotiated company terms and conditions for work all the time. I am not a lawyer, if you believe that the terms and conditions may affect you or your company you should seek legal advise from an attorney.

The EULA reads as follows: “You are authorized to use the Licenced Materials only for personal use.”
Does this mean that the user (licensee) is forbidden to create music using Nexus for others? Does this mean that the user is allowed to create music using Nexus in order to listen to it yourself alone? If you made a record using Nexus and then others listen to it, does this mean that the Licenced Materials are used through the record not only for the user's personal use but also for the use of others?

Can reFX create a FAQ on their website explaining those clauses of the reFX EULA that are not very clear for understanding?

I only play my Nexus when I’m alone. Our kid wanted to have a listen to it once but I was worried about the EULA so I sent him out the studio.

That is standard licensing term. Nothing out of the ordinary.

Personal use means that you have to have a license to use the software and materials contained in it for your own use, you cannot have a company and 1 license to use for multiple people. You cannot start an Internet cafe and charge people to use your nexus 5 license, that would not be personal use you would be profiting off your license in that Reguard. Of course you can make music, but you cannot distribute the materials in their raw format - presets, unedited samples, etc. ReFX owns the materials not you. This is standard language in almost every music VST or sample pack music software I own. Go read Microsoft EULA or Apple OS EULA and you will see the same or very similar language. This is nothing out of the ordinary for ReFX. If you were a company or a sound studio with multiple computers you would have to contact ReFX about that and maybe get an enterprise license for use if ReFX offers such. Rob Papen , Spectrosonics (Omnishphere), Native Instruments all have similar language in the EULA’s I have agreed to and licenses. Really if you have concerns about your music production and protecting your music, company then you should seek legal advise from an attorney to see if you can comply by the EULA of the software you use.

Where else have you seen such a term? Thanks for your replies, but I think that it would be better to have some explanations and examples of the correct usage on www.refx.com. Some websites have such information in the form of FAQ. This can be very helpful and convenient.

Is it possible to assign some keys to switch between different articulations of an instrument (preset) in Nexus 5? For example, real string instruments can be used very creatively in terms of articulations.That is why their high-quality virtual counterparts often have the corresponding functionality to a certain extent.

I upgraded from Nexus 2 to Nexus 5 and found a few issues after checking some tracks I have previously exported with STEMS. like a 1 patch suddenly has a total different sound (very bad as I work on this track and used this sound a lot...) + a patch suddenly has trancegate on which wasnt before.

shall I post them here or open a ticket?

Open a ticket and put "Attention Roland" in the ticket to make sure it gets to me. Probably can't take a look until Thursday.

When browsing the wavetables, is it normal to only have a couple of folders visible even if I have a zillion expansions installed? The expansions are mainly older titles, so that might be the reason?
