It's pretty clear to me that they have made a concerted effort to shift to using "Monster" without the "Cable" in their branding, which would be precisely why they are strongarming anyone else using the term "Monster".

The legal action was part of this shift in this calculated strategy to become a giant large bohemouth conglomerate corporation, despite their patronizing response of still being "the little guy".

It's basically megalomania on a corporate scale.

It would be like "Britney Spears" deciding that she now wants to be known only as "Britney" and threatening legal action against all others who were previously born with the name "Britney".. :P

The whole story is here, at Snowmonsters.com. They're a small business that uses cartoon monsters to teach ski safety to children. Noel and his attorney are trying to strongarm Snowmonsters into giving Monster Cable the rights to their cartoon characters, and then forcing Snowmonsters to pay to license them back. If Snowmonsters refuses, Noel will sue, forcing Snowmonsters out of business because of legal costs.

The choice between giving away your business identity and licensing it back or going out of business due to court costs reminds me of the "either your signature or your brains go on this contract," scene in The Godfather. Right now, Noel has similar actions pending against over 100 entities. They'll either pay him or pay their lawyers to fight him off - either way, they'll pay through the nose...What Monster Cable is doing is dispicable - I encourage you to boycott their products, as I have.

well, i read through the madmartian stuff, and i gotta say... f**k monster cable twice over. i loved reading his response to their apology, though... especially enjoyed reading Disney's counterclaim against MC, in so much legal text they really do assert a big "you have the f**king balls to sue DISNEY?!"... fun stuff... and as for people who want quality cables, there's other brands out there. namely MOGAMI, who are tied in with MXL in a way i forget, but i know all the MXL mics are wired with mogami cable and packages often come with mogami cables. very good stuff there.

There's no way that Monster would go through all this for publicity, because it's ONLY negative publicity. Some people will choose to ignore the business practice and continue buying Monster, which is fine, but they're not new customers, just existing customers. Existing customers may also potentially switch their cable-buying dollar elsewhere, so there's more of a chance of lost profit. Potential new customers who only heard of Monster through threads like this will simply NOT buy the cable, so they're missing out on growth opportunities.

Any way you look at it, there's no way that this particular negative publicity will actually be beneficial to them... not when their product isn't THAT special. There are competitors that do the same level of quality.

As for me, I'm doing just fine with my current main guitar cable, which is a Planet Waves. No, it's not touted as the 'best' cable around, but it works like most other lengths of copper wire will work, and it's got a nifty little kill switch on on of the plugs.

or they are a small business person who can't afford a court battle and can't afford to settle, so they end up signing over their future profits. That just f**king stinks! I will pass this on to my college, The Center For Arts and Technology; it's a digital arts school - fuckloads of h.q. cable in there - but the people who run it are very nice, and seem concerned about social issues; hopefully, as tiny as one college might be in the scheme of things, they will agree to not support monster mutherfuc...er, cable.

I am curious why they get away with this... well except for the fact the noel fuckface who owns it and is the exec. makes about 9 million buck a year. that pays for a lot of stalling in court while your small businessperson target starts to lose everything and is finally forced to settle. god dammit, this really gets under my skin!!!!! I don't know why either. there is a hell of a lot of social injustice in the world and yet this for some reason has me enraged! :lol: what the f**k?
But what is really bizare is that the name (I assume) is 'monster cable'. So, monster anything else should be fine. Monster is a noun, and an adjective, and commonly used by millions of people every day. I can see if it was Noel "Fuckface" Lee Cable, and somebody started a company called Noel "Fuckface" Lee Fish Cakes, there would be a case. Or if he had made the word up, as a name for his company, then sure. But this is just baffling from a common sense standpoint.

I'm outraged by this and will never buy any of their product, in any form.

But just to get this straight, this only happens in the U.S. right? So it's just U.S. based companies who are being extorted like that?

This is why we need tort reform here in the U.S. to get rid of junk lawsuits like these. They just sue to get settlements. President Bush wants to pass laws where people and companies can be fined for bringing forth frivolous lawsuits like these, but the Trial lawyers have all of the Democrats in their pockets so it will be a tough battle.

That said, once you buy a Monster cable, they replace it for life if it breaks, no matter how many times you break it. You can just walk into Guitar Center with a broken one and they'll hand you a new one with no questions. It's certainly the best deal you can find. I'll probably never need to buy another guitar cable or mic cable unless they all get stolen or lost.
