But we have to accept that the police can not get involved every time one company does not pay its debts to another company. It is a civil matter.
I completely agree that the police will not deal with this because commercial disputes between companies are regulated by civil law, not criminal law. It’s a pity that the prosecutor refused to initiate a case on suspicion of fraud. Probably the only thing that could prompt the prosecutor's office to act is if we demand VAT reimbursement from the tax authorities, which we paid into the German budget. In that case, the state and German taxpayers would owe Barry Kasoff millions of euros. Then the question will arise as to why the prosecutor’s office did not protect the interests of the citizens.

This is not only a commercial dispute between companies which is regulated by civil law.

I'll repost what I wrote some days ago here:

I was at the police and made an annoucement, as Digital River had sent a notification on December the 11th that the payment for September would have been transmitted to my bank account but no money arrived. This is clearly fraud and a criminal act. The police was very friendly and helpful and took the case very seriously. The police officer was also very interested about the fact that they delay payments or omit payments for so many victims.

The police officer said that I should notify also other affected victims to go to the police to make the German public prosecutors moving. They take it serious, but they can only take action if victims contact them.

I see this text for a couple of weeks now.

Either because
a) they terminated my account as I requested in writing a while ago
b) they are pissed with the refunds I did
c) there is no more money they can steal from my account

since they locked my account I have not received any creditnotes or other communication.
I have not received a creditnote for December. I requested to close my account 1st week of December. So I would have to play the platform fee for December in theory.

Hey guys,

in October, we have sued those DR GmbH guys on the "Landgericht Frankfurt" court, as they have obviously stolen quite some money from us.
While meanwhile they paid July and August, no further payment since... and they still owe A LOT for September and October (since October all our business goes through non-criminal MOR).

The court will handle the case end of February. This delay is unfortunate, as it still is likely that DR GmbH may declare insolvent on end of January. We'll see.

They have to use german lawyers and have to defend themselfes at a german court, as their unilateral declaration that "from January on US law will govern" is null and void, they are a German GmbH.

Their lawyers seem to only play for time, they request a "Fristverlängerung" because
"weil die Abstimmung mit der Mandantin sich aufgrund der Weihnachts-/ Ferienzeit, während der diverse Ansprechpartner nicht verfügbar waren, verzögert hat. Überdies sind die maßgeblichen Ansprechpartner teilweise nicht der deutschen Sprache mächtig, weshalb Übersetzungen gefertigt werden müssen, was zusätzlich Zeit kostet."
which of course we will NOT agree, as this is a further bad joke...

My hope is though, that because they still are operating hundreds of millions payments monthly (e.g. for the big PC hardware guys) that in the end they wont dare a fraudulent bankruptcy of their german subsidiary DR GmbH, and therefore might want to pay at least some of their debts as maybe they scare too much negative coverage in media.

But possibly Barry simply doesn't care.

Time will show.

That's what I always said. The announced migration of jurisdiction to Minnesota was pure intimidation in order EU merchants think it's too costly taking them to court. Deception debunked, Mr. Kasoff...

If they really should delcare bankruptsy at the end of January then this is a clear case of delay of insolvency by deception ("Insolvenzverschleppung"), and in this case the limited liability of "GmbH" falls away and the owner (Kasoff) will be fully liable down to his own assets

Kind of promising, but my KYC ticket was open for 4 months without any progress (except growing worked hours of course).
