I think the issue here is really simple.
It should simply always be the case that you ask permission if you want to access someone's data/works/property. The nature of the data is more or less irrelevant.
At the absolute core is that the right to grant or deny access is fundamentally what defines ownership or authorship in the first place.
(This argument is often missed in discussions about copyright)
I have absolutely zero doubt that Relab's usage of the data is confined to data gathering about the usage of their plugins but the core moral principle doesn't change whether it's data gathering or reading someone's diary.
If something belongs to someone their consent governs its use. When we exchange money for the product it is understood that you’re entering into an agreement that grants permission to use it under the EULA. Which is almost always you get to use the product with no other interference or commitments.
These agreements are essentially a formalised version of the moral principle above.
I find that opt out situations are tantamount to acts of omission and should not be acceptable. Ethically consent should always be affirmative and not inferred or assumed.
