First off, I would not charge him for my advice. Second, legal advice is confidential (attorney-client privilege)l, so I'm not going to post it here or anywhere.

There is a lot of misinformation being spewed, some correct conclusions supported by the wrong reasons and some correct reasons with wrong conclusions. I know that everyone's tryng to be helpful, but, you really have to careful giving legal advice to people when (1) you're not a licensed lawyer and (2) you are musicians who have a very long history of not understanding the laws that affect your profession and livelihood.

The Japanese trademark firm that handles my client's trademark applications in Japan works on Roland matters - I'm sure having that card in my deck could be helpful to Adam.

No offense meant, but the reason there is lots of misinformation being spoken (spewed sounds a bit derogatory) is because lawyers never just publicly post useful information so that people are informed. Until they do that, lawyers have no grounds to be exasperated that people try to inform and advise each other.

AdInfinitum: i'm interested to know because i'm in a very similar position to Adam .. working on a softsynth which looks like another of Roland's synths :scared:
It doesn't matter how it sounds..
..as long as it has BASS and it's LOUD!

It's not really up to lawyers to make sure that laws are understood, it's the people who pass those laws.

There are lots of places where you can find information on copyright law and, yes, some of it is very complex and difficult to understand sometimes... but there's a lot of advice been given in this thread which is basically "Here's what I think off the top of my head without bothering to look into it". And I think it's a bit irresponsible to give out such advice which could potentially land Adam Trance and others in trouble just because you want to have your say on a forum thread.

I don't disagree George that everyone has a right to have their say, but you do have to be careful about giving advice to people. There's a big difference between debate (which is where everyone can get involved) and handing out legal advice (where you should only pipe up if you know what you're saying is true).

Me too! I did that to my Saturn 09!

Neither Poland nor Roland sued me for it. ;)

I find it pretty generous of AdInfinitum to offer professional advice for free to Adam.

Some of the advice in this thread indeed looks rather scary to me, as it's completely contradicting to my own lawyer's advice, as far as I understand it.

Also, in some countries a lawyer will charge a considerable amount of money for a cease & desist letter, so it's not to be taken lightheartedly.

Well this topic getting really big :D

About all the gui talk - this is really lol!

There are so many guys out, which copied the virus gui 1:1 and use also the same font's for here synth-logo etc, or other called here plugin benassi vst and fish users with illegal usage of an artist name etc - but this what Adam did is absolutly ok, and why?

He build a great emulation of the JP, which sounds very good and looks also good, and HELLO it's a JP-emu - so it must looks like the JP!

So if he didn't copied it 1:1 via photo/screenshot work it's absolutly ok!
And at the end counts only how it sounds and how good it's to use/user friendly etc...

So why you are not happy that Adam build there somethign really nice, which comes perhaps as freeware? ....
Sometimes topics on KVR getting really strange twist and content-changes

If I've missed someone staying this earlier, forgive me, but why not do the most obvious thing; ask Roland directly if they care or not? If they say yes, they care, then ask them what they would want you to change so that they don't care. Give it a shot. Much easier than speculating all day long, or dealing with lawyers.

well, maybe even ask for a grant, who knows? :help:

i like proverbs, so the one that's appropriate here is 'don't ask don't tell' and again 'don't take treatment before the headache' and don't capitulate ahead of war

it's some KVRians who care too much about this project, not Roland
