This is the case peer-to-peer file sharers have been waiting for. Tanya Andersen, a 41 year old disabled single mother living in Oregon, has countersued the RIAA for Oregon RICO violations, fraud, invasion of privacy, abuse of process, electronic trespass, violation of the Computer Fraud and Abuse Act, negligent misrepresentation, the tort of "outrage", and deceptive business practices.

It may well hinge on the wording of the offer to settle - if it appears that RIAA intiated a court process always with the intention of using an offer to settle far below the redress the original plaint could have awarded them, that's an abuse of the court, and if they've done that on an industrial scale - and they have issued 13,500 plaints - that's RICO.

Could run and run.

With 13,500 plaints out there, I can smell a class action suit, once people get a wiff of this - not only does it at least postpone the day you have to pay RIAA anything at all, it might just work.

I can't see RIAA continuing to issue any more writs in Oregon once this hits the bench.
