Sampling Of Synths?

Hi guys, i was just wondering what is the status on sampling old synths these days is it legal? Could you give the samples away for free or even sell the default soundbanks?

Ah so i could use the saw i liked from an old analog synth, cool thanks for the info 
I usually edit all my samples in any case but was just wondering about this in general
