I have a question about IK and SR sample licenses.

I know we're not allowed to use the material to create our own sample library.

But... If I create a piece of music, am I allowed to let other people sample it? Am I allowed to give stems to people for remixing?

If I have full copyright of my music that's been created with samples from IK and SR, doesn't that mean that there's a loophole where I can make a piece of music with lots of dry solo samples, and let someone sample my music (which they then chop up into individual samples) to use in their own music?

The main thing in sample license agreements (not just IK and SR's) is that you are licensed to use the samples in your MUSIC. But, one of the things you clearly do not have the rights to is to use it to create other sample libraries from it (at least not without permission from the copyright owner of the samples).

So, if it is chopped up to the point where it is like a sample library then it is a problem. But, if it is chopped up into segments of music say for remixing or beds then that is NOT a problem (except for some libraries from some companies but not from us... I actually did some programming on a title called "Symphonic Adventures" and I think that one has restrictions for even library music).

If you are talking about collaborating with someone musically and you are chopping up this and that for something you are co-producing or writing I wouldn't worry too much about it. But, if it was something you were planning on distributing or selling to a bunch of people then it'd have to be MUSICAL PIECES and not chopped up sounds or loops to MAKE other musical pieces (ie. a sample library).

Ok, I think I get it.. so private distribution of separated material is ok (eg stems for a film job)? However...

Does this mean I can't run a public remix competition of any music I make with IK or SR samples? This would involve distributing sound files that may have naked samples in them...

Depends but on the naked samples part no. On your MUSIC perhaps yes. Fine line there. However, if you are talking specifically about really doing this (not just hypothetically) and it has to do with SR sounds then I am pretty cool about it. Maybe not playable multisamples but loops made with our drums for a project like that etc. One can always ask privately when there is something specific. If you have permission then that changes a lot things.

I'm working on a song in the style of a chart-topping-radio-hit... and I thought it'd be fun to have a bunch of people do some remixes of it. I'd do a competition, but I don't have any prizes to give out. :(

Speaking of competitions though, I've been thinking for a while that it might be fun to do a competition to promote SR material. Do something like limit it to the free sounds (ST2LE people have a different category maybe), and have some soundware as the prize. Maybe even custom soundware. I don't know if it'd be financially viable to do several like this each year. If I was working for you guys, I'd be up for making some custom soundware for the competitions (as well as running them). :lol: :wink:
