If one uses a warezed version of a software which goes around the EULA and you never agree to it, but still use the software, is one still legaly binded to the contract?

hee hee, this is a fun thread. Well, I gotta get back to creating some more software... or should that be "engineering", since certain factions deny the involvement of the creative process in instrument and sound creation. Nooo, I didn't say that! Quick, my asbestos suit! arrrrrrrrgh

Just to clarify, there is no problem with using BFD for your music or other creative works. The license is quite clear about that. What there is a problem with is making new sample libraries with it, commercial or otherwise, without our permission. This is because it could compete with our own product, and it devalues it for people who own it. In this case we chose to allow it, as the scope of what Hans is doing is not a threat to us, and there was no malicious intent. We're good enough to examine each case on its own circumstances. If someone was making money from doing something similar, the terms would not be the same. Is this really so hard to understand?
As Angus said, it's a 2-way thing. Sticking to those rules is the user's part of the deal. Ours is to support the product when new OS's come out, fix bugs, add new features and give tech support.
As someone brought the hardware argument into it - to get new features like the ones we add is rare with hardware, and certainly unheard of for free. What's the hardware alternative in this case? Well, to record your own drums. And even though it's easy to dismiss this as a trivial, 'uncreative' task (I'll let others debate the uselessness of people like George Martin, James Brown, Steve Albini, Trevor Horn etc), anyone who's ever tried will tell you it takes at least a day of mic-ing up, money to hire mics, pre's, studio space and all the other equipment needed, and the *paid* time of the people who have the knowledge and expertise to do it well. It costs a hell of a lot more in money, time and stress than the cost of BFD and its expansion packs.

I cant believe this thread is actually still going on.
The one and only person it actually concerns is a happy bunny , no one died , got run over , had there cat stolen.

----Hey, I'm glad to have been wrong in this particular case, because as most of us seem to know, the copyright issue is extremely serious and fairly ugly these days. Props to FXpansion/Steve Duda for not only allowing this use of their samples, but endorsing it, I still have to assume this an exception to the rule type of situation, but it's a good precedent at any rate.

Amid all the arguing, there hasn't been enough of a nod to Drainage for the quality of the playing and the excellent samples (can't really call them loops yet, can we?) involved. I'd like to see these in .wav format, but am sure happy to have them. Thanks, "D", for making these available in the first place. You are welcome to sit in with my band anytime you're in the Austin area, mate...

Good suggestion, midi's would be cool too, & these kind of files doesn't take a lot of bandswitch to distribute.nickkbh wrote:So what about posting midi files.....with a describtion and suggestions of what drums to use...that would actually be way cooler.
