What can't I use the sounds for?

You cannot use the sounds in isolation (i.e. when they are not used within musical compositions) as part of a commercially released project. For example, you cannot use the sounds to make another Sample CD, or include them as individual sound samples on a multimedia CD, gaming machine, or toy, that is commercially distributed. You must add substantial instrumentation to loops* (*loops are compositions that contain a combination of sound samples that can be repeated to form a continuous piece of music). You cannot upload or download the sound samples to any database or server, unless they are used in a musical composition (in combination with other sounds) created by you.

Doesn't the guy behind the EWQL stuff make movie trailers? I think I remember some of the libraries from EW being from his private collection for making movie trailers, so to avoid competition, he threw in the "no-trailers" clause in the contract. Am I wrong there?

I agree with most here....IMO, it's pretty dumb. The only restrictions I see as being fit for these types of sample-based instruments are limited to commercial sample production. Oh well...vote with your wallet I guess. :shrug: hehe, I think I've just ensured that I will never be doing any work for EW.

Yes, this is OK unless you want to put samples created with Spectrasonics Virtual Instruments directly encoded into the game. That requires an additional license.
And here, the "bend the rules" thing applies. What is actually ment by that? Single stabs? Or all material?

What if I change it slightly or layer it with a different sound? Then it's a totally new sound, isn't it?

You see... these EULA's are stating "something", but not everything. Then again, who pays all those royalties in the real world, or have you SEEN games that actually mention "OST made with this and that synth"? Well? Me neither, but I know for a FACT, that Halo's first OST used a "Gregorian Choir" from a well known sample firm, yet it wasn't mentioned in the credits.

no, its not its a derived sound, and not totally new. if it was totally new, it wouldn't have had the previous samples as source material. :roll:

Nope. All Spectrasonics is saying in that particular passage of the license is that if you write music or create sound FX using their libraries that get embedded in the video game itself (level sounds/background music/etc) that you would need to purchase an additional license to do so.

:wink: You guys must be thinking about QL Voice of the Apocalypse, which I believe had special restrictions for trailer use (unless it's also used in the film for said trailer), per Nick Phoenix.

I never heard of any other restrictions on EastWest libraries, other than restrictions against using their loops in music library compositions.
