Why not? The least you can do is ask a lawyer for advice and see if you have a strong case here (I think you do, but I'm not a lawyer).

Shouldn't these illegal practices be put to an end? Don't fear a legal fight here, and don't underestimate what a lawyer can do for you (I do have experience on that matter as a client :) )

And if you do decide to get in contact with legal help, delete and don't put any new details about your case in public :wink:

That really seems unfair and wrong on so many levels... Situations like these remind me that I wanted to buy a legal expenses insurance since years. Good luck, I really hope that someday you can laugh about this mess and have profited from their mistake.

PS: There is the well-known law blog in Germany; if you email the owner (Udo Vetter) and tell your story, and if you're lucky, he may have some useful advice. He offered help in a few similar cases. He's really great, but I guess he gets hundreds of questions each week... But may be worth a try. It's just one email, after all.

Sorry to hear about this act of infringement. If it were me, my lawyer would be frothing at the mouth!

I always thought that Wersi was a solid company, what they have done has no excuses. This is not the first time that a company which is about to die do something illegal (I don't want to derail the thread but I'm talking also for personal experience), I can't imagine what they think when decide to do something like this, really.

Guido I hope you can have some kind of refund but please just try anything you can, don't let them run with your moneys :x In this case to contact a lawyer and try to persecute them legally is the best thing you can do.

So sorry to read about your troubles mate!

If you could open a dialogue with the new company MSC (?) and explain the situation, perhaps they might be able to give you a list of purchasers of the NFR version. Especially if they want to have a future relationship with you and your synth.

Then you might be able to contact the folks on the list and offer a cheep 'upgrade plan' from the stolen software to your legitimate version with updates and support etc.

At least you would see some benefit and make some money, even if its just a fraction...

Well, I would never had imagined that an act of piracy could ever been done by a well known manufacturer of home organs and digital keyboards, I'm talking about WERSI, have you ever heard about this brand?

Here's the (short) story: a while back I was contacted by a certain Ulrich Wildhack, who was in charge for Wersi as a chairman and salesman, over a possible collaboration for including my VB3 into their own software as an addition to or replacement of NI B4. For this purpose, they asked me a NFR (Not For Resale) license of VB3 in order to test the software on their keyboards.

After a few months of silence from both parties, I was contacted by a friend of mine who invited me to visit WERSI's website, onto which there was a news headline reporting that the new software upgrade had been released and it also included VB3! I was not aware of this and I wasn't even asked permission for proceeding. They practically "embedded" the NFR license I gave them into their software package.

In the meanwhile, WERSI went out of business towards the beginning of 2010. Someone told me that they already started selling those "packages" with the same NFR license for 100 euros each. And I wasn't informed, wasn't asked permission, and I didn't get a single dime either!

Tomorning the confirmation arrives: a belgian guy sends me an email telling that he bought VB3 from Wersi last years, and he wanted to know if he could update it to the latest version. He said he paid 100 euros for it.

Now the "WERSI" brand name belongs to Musik Store - Cologne, and the gentlemen who scammed me and their customers has nothing to do with WERSI any more.

But, well, you know the story now.
Guido, Meffy, I've been thinking about this (comment: As a Wersi equip owner, as well as a VB3 license holder, this situation is heartbreaking)

I don't know if this idea has any merit, but I'd like to do something...OK, Guido: What if you put together a GB for 'Key Performer'; I personally promise to join the GB, and I assume that others here will as well....The point being that maybe we @ KVR can collectively get you at least a portion of your lost revenue....

I checked out the link http://www.wild-noise.de/ and it is pretty darn obvious (to me at least) they have finished the project using NuBiPlus/Spinner as a starting point - and are offering it for sale. I should add that along the way they did find a couple of things that they needed to change and it is probably a better product as a result.
