Recreate the Linn LM1 Drum sounds

I read on the net (various sites) that it's alright to sample a 808 drum machine, because it's not a sample, but pure synth, I have always loved the sound of the Linn LM1 Drum, but because it's sample based, I've been told that it's not legal to sample it, not sure on these ebay sites selling these samples.....My question is, would it be possible to Recreate the Linn Drum sounds, using Zebra, that would surly make it legal, because it would be just pure synthesis, I would not be creating it to sell under the Linn name, but just to use in any of my musicial work, and it would be a labour of love to Recreate these classic sounds, just need to know if it's possible and the best way to achieve it.

Michael Kastrup spent considerable effort to recreate Roland D50 sounds in his Zebra Hybrids soundset. While not exact I'd say he got close enough for nostalgia purposes and I think with the right amount of patience and deconstruction of sounds it's possible. How much work it'd take is another issue altogether.
