I have a feeling, they've been asked to answer some questions in a court of law, or that letters of intent may have been written.

It's just a thought but they must have been asked to prove their rationale and rights to the IP, I feel it could be a tight squeeze between working relationship and patent to be fair.

I do find the whole thing a bit to close to the edit. If I was Gehard I would probably take a step back to consult with my legal reps, where a new business is in development where a bunch of previous employees worked with Ableton and then copied a software system idea from the ground up. however with existing developers it's harder to prove any plagiarism.

I say this because it's been quieter than quiet in the Bitwig camp, and frankly you would have at least put out a few friendly reminders you still exist, if you were happy about your IP wouldn't you?

if Ableton could sue Bitwig, then why didn't Steinberg sue Emagic or whoever they were, or Cakewalk, or ProTools, blah blah.

The 'classic' DAWs are all every bit as much alike one another as bitwig is like ableton, so why anyone thinks there are actual grounds for legal action in this matter is beyond me.

It will depend on many things such as the individual employment contracts of the employees that left, patents and the amount of money Ableton can throw at lawyers (you don't have to be right, you just have to keep your competitor in court until they bankrupt)

To be honest, Ableton was original enough in concept to have some IP rights on, but the Abes would probably have grounds to say some of the development/ideas or even code was originated whilst the Bitwig people still worked at Ableton (that's what normally happens!!)

The reality is that Bitwig had what appeared to be a fully working product 8 months ago (from the videos), most new companies wold be taking discounted pre orders, open betas etc, the only reason a new company wold be almost invisible is legal action.

KVR would be a lot more informative and a lot more bland without the speculation.

I'm guessing they are quiet because they are working at max steam trying to get a solid July 11th reveal ready and are probably likely tired of all the whining of how terrible they are and they blew it that they see on the internets.

But it would be cold blooded for Ableton to wait years for Bitwig to near release date before springing a lawsuit against them... on the otherhand the news of bitwig studio has been so loud for a couple of years now that for Ableton to wait to sue could weaken it's case... if there is a case.. if there is a lawsuit... which none of us posting are aware either way. :hihi:
