I may have misapplied my example with the movies. So here is a solid piece of advice for most life situations, what would Mr. C advice Richie to do? Say Richie wanted to kiss another fellow's girl. After intense debate over moral implications like how big was the other fellow, how much Richie liked the girl and was the other fellow Fonzie, Mr. C. would say just don't kiss the other fellow's girl Richie.

Just don't take the other fellow's work and resell it. It's pretty simple.

I make sample packs too. In my honest opinion its best to just synthesize all your drum sounds from scratch. Is it likely you will get caught with all these samples sounding so alike?
No. But it still does not make it right or legal. And if you did get caught you could be in deep shit.

The same technique of decomposing a sound can be applied to any types of sounds.
