I think melodies should not be copyrighted at all, only performances so that one can't sample them.
There are only so many possible melodies, anyway, and it is very likely that several people on this planet come up with the same melody independently.

Is it easier to make the melody up or comb their massive database? Pick one and have fun, I guess.

This will all eventually boil down to individual recordings.
