Right! I had exactly the same direction in thinking and ended up concluding that it is more like an instrument than effect. I assume it is not allowed since it is sample based, right? The Live Scratcher is preloaded with 2 samples. By the chance I'm not loading any custom sample wouldn't it lay under the similar terms as wavetable synth and still be allowed? (by not using it for straight unmodiefied sample playback)
Theoretically you should not be able to use it on your own rendered audio cause one is not supposed to modify a part once bounced to audio (Although I'm pretty sure that has happened in the past using EQ and compression to mix bounced tracks and no one really cares)
Also built-in wave-tables have always been allowed but not patches with built-in samples

I think for legal OSC scratching, just utilize the pitch/filter automation of a synth....I used Synth1 to try and replicate the weird horny/kazoo scratchy sound in this... I did all the music from scratch, guitars/drums/whatever (trying to keep it true to the original) and the vocalist and drummer from my old band did the vox....

Just to confirm: In Vital I can only use the factory samples? (BART, Box fan, grinder, HVAC...)? I can't edit one of those or put anything else in there?

Anyone...? A kick sample (kick in the SMP) put through the comb filter sounds great in vital. But you can make a kick that sounds just like it with the oscillators and it sounds like crap when run through the comb filter. If I could make a kick in vital and then run it through the the SMP... would that be legal?

I would therefore say: No, not legal.
"Can I freeze one kickdrum kick and copy it all over the place to get a stable kick" is sort of a similar question, asked at times in the past. And the reply was always: No, you can only freeze the whole tracks, not a single kick in order to copy it.
But @Richard, you have the final word.
On top of that, Vital gives you so much tools to shape the sound of a kick, 3 filters with drive, compressor, EQ, distortion ... and all that is modulateable. Have you ever tried to modulate EQ highshelve and/or distortion amount with a punchy Env? ontop we can use EQ+Compressor to shape spectrum and punch outside of the synth.
